Significant changes to the Civil Servants Law: Regulations on annual leave, appointments, and additional indicators
The regulation accepted by the TBMM Planning and Budget Committee concerns 950 thousand public personnel. While significant changes are being made to the Civil Servants Law, new regulations have also been introduced regarding issues such as annual leave, appointments, and additional indicators.
The Draft Law on Amendments to the Civil Servants Law and Certain Laws and Decree-Laws, which also includes regulations regarding civil servants, was approved by the TBMM Planning and Budget Committee.
The changes to be made to the Civil Servants Law are summarized as follows:
The regulation that allows civil servants who have not received any disciplinary punishment for 8 years to benefit from an additional grade advancement right will also apply to those who transition from contract status to civil servant positions.
UNPAID LEAVE
With the regulation, contract personnel will also be able to benefit from the rights enjoyed by civil servants in 4A positions.
These include important issues such as the transfer of annual leave rights and unpaid leave.
With the proposal, amendments are being made to Decree-Law No. 375 in accordance with the cancellation decisions of the Constitutional Court.
Accordingly, for those serving in staff titles or service classes not listed in the attached schedule (IV) of the Law, the additional indicator figures included in the attached schedule (I) of the Civil Servants Law will be taken into account.
This provision will enter into force on the date of publication of the regulation, effective from January 15, 2023.
The provisions of the third paragraph will not apply to those appointed to senior public administrator staff, positions, and duties, excluding staff, positions, and duties determined to be equivalent to or higher than a ministry general manager, and provincial and regional manager staff or positions, in terms of additional indicators.
Contract personnel will also benefit from grade advancement rights just like civil servants in 4A positions. While this situation increases the personnel's salary, it will also contribute to their retirement pension and bonus. The omnibus law also includes additional regulations regarding civil servants.
According to the draft law, which also includes regulations regarding civil servants, appointments to permanent positions in foreign organizations will be made by the President upon the proposal of the minister or the authorized appointing officer.
Those who are currently serving in the status of term-based personnel tied to a position at the Presidency on the date of publication of this provision, among the assistants and interns of the central organization staff or positions whose recruitment, training, and qualifications are of the same or similar nature as the central organization staff specified in the Civil Servants Law, may be appointed to the positions titled Presidential Rapporteur Assistant within one month following the application, provided that they apply within 15 days from the date the regulation enters into force and are deemed appropriate.
