Huge hike for landlord-tenant lawsuits
The Union of Turkish Bar Associations' new Minimum Attorney Fee Schedule has entered into force. With the new schedule, the cost of filing a lawsuit has increased significantly, with total expenses for landlord-tenant disputes in particular reaching up to 59 thousand liras.
The Union of Turkish Bar Associations (TBB) has published the Minimum Attorney Fee Schedule for the 2025–2026 period. The new schedule has led to serious increases in costs for citizens wishing to file a lawsuit.
TOTAL EXPENSES IN RENTAL DISPUTES REACH 59 THOUSAND LIRAS
According to the new schedule, a person wishing to file a rental lawsuit will have to pay 30 thousand liras as an attorney fee. An additional fee of 9 thousand liras will be requested for enforcement proceedings related to the lawsuit, and 20 thousand liras for eviction lawsuits.
Thus, the total cost of a rental lawsuit, including enforcement and eviction processes, could reach up to 59 thousand liras.
If the lawsuit is lost, the same amounts will have to be paid to the opposing party's attorney. Furthermore, court fees and other litigation expenses will also create an additional burden for the plaintiff.
36 PERCENT INCREASE IMPLEMENTED
According to the TBB's statement, an average increase of 36.15 percent has been implemented in fixed fees within the scope of the 2025–2026 Minimum Attorney Fee Schedule.
Additionally, a new 13 percent bracket has been added to the proportional fee scale.
According to the new regulation, public institutions, organizations, and private companies will pay their contract attorneys at least 33 thousand liras.
NEW FEES DETERMINED BY CASE TYPE
Magistrate Civil (Rental) Lawsuits: 30,000 TL
Enforcement Proceedings: 9,000 TL
Eviction Lawsuit: 20,000 TL
Civil Court of First Instance Lawsuits: 45,000 TL
Consumer Lawsuits: 22,500 TL
Assize Court Lawsuits: 65,000 TL
Administrative and Tax Lawsuits: 30,000 TL
According to this table, rental disputes, which are among the most common lawsuits faced by citizens, have become some of the most costly cases when combined with eviction and enforcement processes.
CONSULTATION FEES ALSO UPDATED
Fees for verbal consultations held with an attorney at their office have also increased. Accordingly, the consultation fee for the first hour has been set at 4 thousand liras, and 1,800 liras for each subsequent hour.
The fee for one hour of consultation provided by an attorney on-call outside the office has become 7 thousand liras.
HIKE IN MANDATORY ATTORNEY FEES
Within the scope of the new schedule, the minimum wage for attorneys whose employment is mandatory in joint-stock companies has been set at 45 thousand liras.
For contract attorneys working in building cooperatives, the new fee has become 27 thousand liras.
