New procedures and principles for BOTAŞ's natural gas purchases have entered into force

The new procedures and principles to be applied by the Petroleum Pipeline Corporation (BOTAŞ) in its natural gas purchases have entered into force. The Presidential Decree regarding the matter was published in the Official Gazette.

The regulation covers purchases to be made by BOTAŞ within the scope of Article 3, paragraph (m) of the Public Procurement Law No. 4734. Accordingly, all types of natural gas purchases to be made by the institution from national and international markets, as well as the purchasing methods, execution, and finalization processes related to these purchases, will be carried out according to the new principles.

Market research and evaluation will be conducted by administrative personnel for natural gas purchases. In this context, factors such as offers received for previous purchases, developments affecting purchases in international markets, and the current activities of companies in the market will be taken into account. Various information sources, primarily international natural gas market publications, will be utilized in the evaluations.

According to the decree, companies that have previously committed contract violations in their transactions with BOTAŞ may be removed from the qualification list as a result of the administration's evaluation.

The addition of new companies to the qualification list can be carried out with the approval of the Board of Directors, taking into account market conditions, new companies entering the sector, and BOTAŞ's purchasing strategies. The processes of adding to and removing from the list will be conducted according to impartial evaluation criteria determined by the administration.

The procedures and principles also include regulations regarding the direct procurement method, the non-advertised negotiated procurement method, prohibited acts and behaviors, and penal provisions.
