New refund account step from the CMB for funds under liquidation: 'Those who made exorbitant profits can return the money they obtained'

The Capital Markets Board (CMB) has taken a new step regarding investment funds that have been placed under liquidation. The Board announced that special accounts have been opened to allow individuals who are stated to have obtained "exorbitant profits" by selling participation shares before the liquidation decision to voluntarily return these amounts.

According to the CMB's "Announcement Regarding Voluntary Refund Accounts" dated October 1, 2026, separate accounts have been created at Birleşik Fon Bankası on behalf of the Savings Deposit Insurance Fund (TMSF) for funds liquidated under the Capital Markets Law No. 6362 and related legislation.

The amounts deposited into these accounts will be included solely in the liquidation assets of the relevant fund. It was stated that the returned funds will not be transferred to another fund or a different account.

These amounts will be transferred to T.C. Ziraat Bankası A.Ş. and Türkiye İş Bankası A.Ş., which are tasked with liquidation proceedings, to be used in payments to be made to the participation share holders of the funds under liquidation.

The announcement also reported that a separate regulation has been made for the refund of exorbitant profits obtained from company shares traded on the stock exchange, in addition to investment funds. In this context, a "General Share Refund Account" has been opened at Birleşik Fon Bankası on behalf of the TMSF for those who wish to repay exorbitant profits arising from the buying and selling of shares of publicly traded partnerships and similar transactions.

The CMB announced that the codes, fund names, founder information, and IBAN details regarding the accounts opened on a fund basis have been published in the annex of the announcement.
