New regulation from the Social Security Institution (SGK) concerning employees and employers: Those records will now be considered evidence

The Social Security Institution (SGK) has implemented a new practice in the fight against unregistered employment. Official reports prepared by public officials will be accepted as evidence in the detection of uninsured work. With this regulation, the path is cleared for granting insurance service for identified working days, while rules regarding entry into employment and objection processes have also been clarified.

New regulation from the Social Security Institution (SGK) concerning employees and employers: Those records will now be considered evidence

The Social Security Institution (SGK) has determined new procedures and principles regarding how official records from public institutions will be converted into service for uninsured work within the scope of 4/a (SSK).

With the regulation, if it is determined that a person was actually working in reports kept by public officials and authorized inspection units, these records will be accepted directly as evidence. Thus, premium service notification can be made for every day the employment relationship is documented.

OFFICIAL REPORTS WILL BE CONSIDERED EVIDENCE

According to the new circular, if a person's actual employment is included in official documents prepared by public officials such as law enforcement, municipal police, doctors, veterinarians, or engineers, proceedings will be initiated by the SGK. It is envisaged that at least 1 day of service will be credited to the relevant person based on the date of the report.

Traffic fine reports issued to individuals by traffic police and gendarmerie teams will also be evaluated as a data source in determining unregistered work. These documents will first be examined by the SGK's Fight Against Unregistered Employment (KADİM) services. After those who are already understood to be working with insurance at the same workplace are separated, the remaining files will be sent to social security inspectors.

In the event of multiple official findings, the first document will be accepted as the employee's start date at the same workplace. 1 day of premium service will be provided for each day identified in the same month and in subsequent months. These works will be processed as part-time work within the scope of the legislation.

In the event that there is a month without any findings in between, the first finding in the following month will be considered a new employment entry. The previous work will be closed as a termination of employment as of the last day service was provided.

Employees or employers who claim that the work was not part-time but uninterrupted and continuous will be able to object. In case of an objection, the file will be referred to social security inspectors for on-site inspection.

With the circular, the SGK has expanded the scope of official evidence regarding actual work, while also binding inspection and objection processes to specific rules for both employees and employers.
