The Energy Market Regulatory Authority (EMRA) has made changes to five regulations concerning the electricity market. The regulations, published in the Official Gazette dated October 19, 2026, include new provisions regarding collateral practices, electricity storage facilities, unlicensed production, distribution system connections, and ancillary service payments.
According to the new regulation, collateral amounts exceeding the amount that distribution companies are required to hold will be refunded within 10 business days upon the user's request. In cases where the collateral amount needs to be increased, the user will also be granted 10 business days to provide the additional collateral.
For users who have paid their system usage invoices in full for the last 24 months and have not defaulted on their collateral, the maximum rate to be taken as a basis for the collateral account has been limited to one fold. In this context, it is envisaged that excess collateral arising from this will be refunded within one month from the date the regulation enters into force.
If there is a deficiency of 20 percent or more in the collateral obligation and this obligation is not fulfilled, distribution companies will report the situation to EMRA.
NEW PRINCIPLES FOR STORAGE AND UNLICENSED PRODUCTION
With the amendments, consumers who wish to install an electricity storage facility with an installed capacity exceeding their contracted power are now required to install an automatic power control unit and an energy cut-off system. For these facilities, the relevant grid operator will be required to provide a favorable connection opinion, and the facility must be located at the same metering point.
The systems to be installed are intended to prevent energy from being fed into the grid and to prevent the withdrawal of energy from the grid in amounts exceeding the contracted power. Collateral submitted for license applications of electricity storage production facilities has also been included in the scope of the regulation; accordingly, the collateral will not be refunded until the entire production facility becomes operational.
New provisions have also been introduced for unlicensed electricity production facilities. Distribution companies and certain organized industrial zones will be able to remotely control facilities within the scope in order to implement emergency instructions within the scope of the balancing power market.
In the event that the emergency situation ends, the grid operator will notify the facility owner of the situation within 15 minutes at the latest. Re-energizing the facility will be the responsibility of the facility owner. No payment will be made for production corresponding to the portion of emergency instructions that are not fulfilled.
Unlicensed electricity producers within a certain scope will be required to apply to the grid operator within 60 days from the entry into force of the regulation to request the revision of their connection agreements. It has been decided that some penalty clauses in connection agreements will not be applied until April 30, 2027.
The calculation and monitoring criteria for demand-side participation payments within the scope of ancillary services have also been changed. According to the new principles, payments will consist of the monthly capacity fee and the activation fee that arises if the given instruction is fulfilled.
