Following the resignation of Capital Markets Board (CMB) Chairman Mahmut Sütcü due to health issues, his legal rights regarding payments he will receive from the institution have become a subject of debate.
Sütcü, who was appointed as CMB Chairman on May 9, 2026, with the signature of AKP Chairman and President Recep Tayyip Erdoğan, remained in this position for approximately five months. Sütcü, who had been serving as the Second Chairman of the CMB since November 2024, resigned during a period when a fund crisis affecting over 500 thousand investors is ongoing.
In accordance with Article 132 of the relevant law, titled "Departure of Board Chairman and members from office," board chairmen and members may continue to receive all kinds of payments they were receiving from the Board until they begin a new position or job. The duration of this right cannot exceed two years.
According to reports by Sözcü, under this regulation, it is stated that Sütcü may continue to receive his salary and other payments from the CMB until he starts a new job, provided that it does not exceed two years.
Sütcü's situation has also reopened the debate surrounding the example of former Central Bank of the Republic of Turkey Governor Hafize Gaye Erkan, who also made headlines after it was revealed she continued to receive payments within the framework of her legal rights following her departure from office.
