Teaching Profession Law Proposal accepted in the Grand National Assembly of Turkey: What are the articles in the proposal?
The Teaching Profession Law Proposal has been accepted by the Grand National Assembly of Turkey (TBMM) Committee on National Education, Culture, Youth and Sports. Accordingly, in the event that the crimes of "intentional injury," "threat," "insult," and "resisting to prevent the performance of duty" are committed against teachers in official and private educational institutions affiliated with the Ministry of National Education due to their duties, the penalties will be increased by half, and the provisions for the suspension of prison sentences will not be applied.
The proposal regulates the selection, training, appointment, rights, duties and responsibilities, awards and penalties, career advancement of teachers who carry out education and training services, and other matters related to the teaching profession, as well as the establishment, duties, organizational structure, and personnel of the National Education Academy.
The regulation also codifies the rights, duties, and responsibilities of teachers.
Accordingly, teachers will raise their students as virtuous individuals who are committed to the basic principles expressed in the Constitution, have adopted the national, spiritual, moral, and cultural values of the Turkish nation, and feel responsible towards their country, the society they live in, and humanity; they will strive for the physical, mental, emotional, social, and moral development of students, and will cooperate with their colleagues, families, and guardians in this direction.
Teachers will take into account the learning styles, interests, and talents of students and respect their personal rights, and will strive to protect students from all kinds of negative words, attitudes, and behaviors in the education and training environment.
Teachers will be responsible for attending classes, keeping watch, taking part in centralized or local examinations, participating in boards and commissions, ceremonies and meetings, activities for students and club activities, carrying out student guidance services, coordinating training requiring practice, and carrying out other work and transactions related to education and training processes.
Teachers cannot be assigned to work and activities unrelated to their profession without their consent, except for matters clearly defined in the legislation and in cases of state of emergency, general disaster, and epidemic diseases.
The proposal also regulates the duties and responsibilities of administrators.
The procedures and principles regarding the rights, duties, and responsibilities of teachers, as well as their other duties in education and training processes, and matters regarding the duties and responsibilities of administrators according to school type and level, will be determined by a regulation to be issued by the Ministry.
QUALIFICATIONS AND SELECTION OF TEACHERS
The proposal defines teaching as a special specialized profession that requires preparation in terms of general culture, special field training, and professional knowledge of teaching.
Those to be employed as teachers will be selected from among those who have graduated from higher education programs that serve as a source for the teaching profession at at least the undergraduate level, or from equivalent foreign higher education programs, and who are successful in preparatory training.
The qualifications to be sought in those to be employed as teachers in terms of general culture, special field training, and professional knowledge of teaching, as well as the higher education programs that will serve as a source for teaching fields, will be determined by the Ministry based on these qualifications.
PREPARATORY TRAINING
Preparatory training, consisting of theoretical and practical courses determined within the framework of teaching profession competencies, will be provided by the National Education Academy. The teaching profession competencies, which include the knowledge, skills, attitudes, and values required by the teaching profession, will be determined by the Ministry.
The duration of the preparatory training will be 4 semesters. This period may be applied as 3 semesters depending on the higher education program from which the teacher candidate graduated. The content, duration, and other matters related to the preparatory training will be determined by a regulation to be issued by the Ministry.
DETERMINATION OF THOSE TO BE ADMITTED TO PREPARATORY TRAINING
According to the proposal, the conditions to be sought for those to be admitted to preparatory training are as follows:
"To be a Turkish citizen, not to be deprived of public rights, not to have been convicted of an intentional crime for one year or more, even if the periods specified in the Turkish Penal Code have passed, or even if pardoned, for crimes against the security of the state, crimes against the constitutional order and the functioning of this order, embezzlement, extortion, bribery, theft, fraud, forgery, abuse of trust, fraudulent bankruptcy, rigging the bid, rigging the performance of the act, laundering assets derived from crime, smuggling, manufacturing and trading drugs or stimulants, facilitating the use of drugs or stimulants, purchasing, accepting or possessing drugs or stimulants for use, or using drugs or stimulants, indecent acts, obscenity and prostitution crimes, and crimes against sexual immunity, not to have been dismissed from civil service or not to have had their teaching terminated according to the regulation, not to have any connection with military service, to have completed active military service or to have had active military service postponed or to have been transferred to the reserve class, to have graduated from the higher education programs determined by the Ministry for the field in which they will be appointed as teachers, to have the exam score to be determined by the Ministry according to the fields from the exams conducted by the Assessment, Selection and Placement Center (ÖSYM), and not to have a condition that prevents them from performing the teaching duty in terms of health status."
Candidates to be admitted to preparatory training will be determined according to the superiority of their exam scores, not exceeding the number of positions for which appointment permission is granted.
In the admission of teacher candidates within the scope of the Anti-Terror Law, Social Services Law, and national athlete status to preparatory training, other conditions except for the "having an exam score" condition will be sought.
Security investigation and archive research will be conducted on those to be admitted to preparatory training.
SUCCESS IN PREPARATORY TRAINING
At least two written exams will be held for each theoretical course in the preparatory training. Those with a grade point average of 60 out of 100 in each course will be considered successful.
Those who fail theoretical courses will be given an additional exam right for each course they fail. Those who score 60 or above in the additional exam will be considered successful in the relevant course. Those who fail any course at the end of the additional exams will be dismissed from the Academy.
In order to determine the level of success in reflecting the knowledge, skills, attitudes, and behaviors acquired in the preparatory training to the education and training environment, the teacher candidate will be evaluated three times.
The evaluation in question will be carried out by the education personnel responsible for the practice, the principal of the educational institution where the practice is conducted, and the practice teacher, based on the teaching profession competencies determined by the Ministry, through an evaluation form created by the Academy according to teaching appointment fields.
The evaluation score will be determined by taking the arithmetic mean of the scores given in the evaluation forms filled out separately by the education personnel responsible for the practice, the educational institution principal, and the practice teacher.
The practical course success score will be determined by taking 20 percent of the first evaluation score, 30 percent of the second evaluation score, and 50 percent of the third evaluation score.
Teacher candidates with a practical course success score of 70 out of 100 or above will be considered successful. Those who fail the practical courses will be dismissed from the Academy.
At the end of the preparatory training, the success score for appointment will be determined by adding 40 percent of the arithmetic mean of the success grades of theoretical courses and 60 percent of the arithmetic mean of the success grades of practical courses.
Attendance at preparatory training will be mandatory. The registration of teacher candidates who cannot or will not be able to attend the preparatory training for a total of 20 days or more during the preparatory training period due to documented health excuses will be frozen to be readmitted to the first preparatory training program following the disappearance of their excuses. Except for documented health excuses, teacher candidates may be granted leave for up to 10 days during the preparatory training period depending on their excuses.
DISMISSAL FROM THE ACADEMY
Teacher candidates who are subsequently understood not to meet any of the conditions in the relevant article regulating the "determination of those to be admitted to preparatory training," or who lose any of these conditions during the preparatory training, those who are punished with expulsion from the Academy as a result of a disciplinary investigation, and those who are unsuccessful in the preparatory training will be dismissed from the Academy.
DISCIPLINARY PENALTIES AND ACTS AND BEHAVIORS REQUIRING DISCIPLINARY PENALTY
The proposal also determined the disciplinary penalties to be applied to teacher candidates and the acts and behaviors corresponding to these penalties.
Accordingly, the acts and behaviors requiring a reprimand penalty, defined as "notifying the teacher candidate that they are at fault in their act and behavior," are as follows:
"Disrupting the order of studies carried out in classes, seminars, exams, practice, and other education and training environments, making it a habit to arrive late or leave early for these studies. Attempting to cheat in exams. Not attending the preparatory training for a total of two days without an excuse. Benefiting from the facilities offered by the Academy without the right to do so or allowing others to benefit from these facilities. Offending Academy personnel or teacher candidates with rude or hurtful words. Engaging in behaviors that negatively affect the order and functioning of the Academy. Sharing audio or images related to educational activities carried out at the Academy outside the procedures determined in the relevant legislation."
The acts and behaviors requiring a one-tenth deduction from the payment regulated by the relevant article are as follows:
"Intentionally reporting the information requested by Academy officials as incomplete or untrue. Drinking alcoholic beverages in areas belonging to the Academy or coming to the Academy drunk. Not attending the preparatory training for a total of 4 days without an excuse. Intentionally destroying existing buildings, fixtures, and similar materials within the Academy or damaging the information system. Engaging in words, behaviors, or written actions that damage the honor and dignity of individuals. Threatening Academy personnel or teacher candidates. Cheating or having others cheat in exams."
The proposal also codifies the "acts and behaviors requiring expulsion from the Academy" for teacher candidates.
The Disciplinary Board will consist of 5 members to be determined for each training program duration, 3 from among the members of the Academic Board by the President of the Academy, and 2 from among the department heads working at the Academy. 5 substitute members will be determined in the same way. The Disciplinary Board will elect a president from among its members at its first meeting.
FINANCIAL AND SOCIAL PROVISIONS REGARDING TEACHER CANDIDATES
During the preparatory training process, teacher candidates will be paid an amount found by multiplying the indicator figure (18,650) by the civil servant monthly coefficient every month. This payment will not be subject to any tax or deduction, except for stamp duty. Those whose registration is frozen within the scope of the relevant article will not be paid during this period.
The military service of teacher candidates who have a military service obligation will be postponed during their training at the Academy.
Teacher candidates will be considered general health insured within the scope of the Social Insurance and General Health Insurance Law during their preparatory training periods. The premiums to be paid to the Social Security Institution on behalf of these persons will be covered by the Ministry's budget, independent of the payment stipulated in the first paragraph for teacher candidates.
EMPLOYMENT IN CONTRACTED TEACHING
Those who successfully complete the preparatory training and meet the necessary conditions will be employed as contracted teachers within the scope of the Civil Servants Law.
The placement of contracted teachers in educational institutions will be made in line with their preferences based on the success score for appointment. Those who do not make a preference and those who cannot be placed in their preferences will be given the right to make a preference again for the remaining vacant educational institutions.
Those who do not make a preference in the second preference period and those who cannot be placed in their preferences will be placed by the Ministry by drawing lots.
Those who do not start their duty in the educational institutions where they are placed without an excuse, and those who leave their duties without an excuse even though they have started, will not be able to apply for contracted teaching again with the success score for appointment they received at the end of the preparatory training, and they will not be admitted to preparatory training for 3 years from the date they were placed.
Contracted teachers cannot be appointed to another place for 3 years, except for life safety and health excuses. In relocations based on family unity excuses, the spouse of the teacher employed as a contracted teacher will be subject to this teacher.
Other matters regarding employment in contracted teaching and the implementation of this article will be determined by a regulation to be issued by the Ministry.
APPOINTMENT TO PERMANENT TEACHING
Contracted teachers who complete a three-year working period will be appointed to teacher positions in the place where they work upon their request. Those appointed to teacher positions cannot be relocated for 1 year, except for relocations based on excuses.
The service periods spent by those appointed to teacher positions in contracted teacher positions will be taken into account in the determination of their acquired right monthly degree and step and in the calculation of service points, provided that they do not exceed the degrees they can rise to according to their educational status. These persons will be entitled to the financial and social rights of the position to which they are appointed starting from the beginning of the month following the date they start their duty, and no offsetting will be made regarding the financial and social rights they received in their previous positions.
Teachers and administrators will be given service points for each calendar year they work.
RELOCATION OF TEACHERS
The relocation of teachers based on excuses and at their own request will be made according to the superiority of service points, taking into account the Ministry's need for teachers and the teacher's preference.
The provisions regarding the qualifications and selection of teachers, preparatory training, determination of those to be admitted to preparatory training, success in preparatory training, dismissal from the Academy, disciplinary penalties and acts and behaviors requiring disciplinary penalty, disciplinary board and implementation of disciplinary penalties, financial and social provisions regarding teacher candidates, and employment in contracted teaching will enter into force as of September 1, 2025.
According to the proposal accepted in the TBMM Committee on National Education, Culture, Youth and Sports, planned, sustainable, monitorable, and integrated professional development activities will be organized by the Ministry of National Education to ensure continuity in the professional development of teachers and administrators. These activities can be carried out centrally or locally.
Professional development activities for teachers and administrators will be determined in accordance with demands and needs, changes and developments in the field of education, and Ministry policies. Individual professional development plans covering five-year periods will be prepared by the Ministry for the personal and professional development of teachers and administrators, taking into account the school type and level they work in and their appointment fields.
Professional development activities will be regularly monitored and evaluated, and the evaluation results will be taken into account in the professional development activities to be planned. The procedures and principles regarding the plans, programs, implementation, and evaluation of the applications to be created regarding the professional development of teachers and administrators will be determined by a regulation to be issued by the Ministry.
CAREER STEPS
The teaching profession will consist of three career steps: teacher, expert teacher, and head teacher. Among teachers, those who have at least 10 years of service in teaching, do not have a penalty of suspension of step advancement, and have completed the training organized by the Academy for expert teaching will be given the title of expert teacher.
Among expert teachers, those who have at least 10 years of service in expert teaching, do not have a penalty of suspension of step advancement, and have completed the training organized by the Academy for head teaching will be given the title of head teacher. Those who have received a penalty of suspension of step advancement will be able to apply for the title of expert teacher or head teacher after their penalties are deleted from their personnel file.
The title of teacher will be utilized from the date the appointment to this duty is approved by the authorized official, and the title of expert teacher or head teacher will be utilized from the date the expert teacher/head teacher certificate is issued. Those who receive the title of expert teacher or head teacher will be given one degree for each title separately. Other matters regarding application, issuance of certificates, and implementation in the advancement of teaching profession career steps will be determined by a regulation to be issued by the Ministry.
ADMINISTRATOR ASSIGNMENT
Candidates to be assigned as educational institution principals or assistant principals for the first time will be admitted to the administrator training program organized by the National Education Academy. Administrator candidates to participate in this program will be determined according to score superiority from among those who score 60 and above in written and/or oral exams. If the written and oral exams are held together, the success score will be determined by taking the arithmetic mean of the written and oral exam scores.
Those admitted to the administrator training program who score 60 and above in the written exam held at the end of this program will be considered successful. These persons will be assigned as administrators with the approval of the governor according to the score superiority obtained in the written exam held according to this paragraph, also taking into account their preferences. Administrators will be assigned for 4 academic years and can serve in the same educational institution with the same title for a maximum of 8 academic years.
The success criteria to be determined by the Ministry will be taken into account in the reassignment of administrators as administrators in the same educational institution or another educational institution. Assignments within the scope of this article will not create an acquired right in terms of personal rights, appointment, and promotion.
Other matters regarding this article will be determined by a regulation to be issued by the Ministry, and the regulation will enter into force on September 1, 2025.
Teacher appointments and administrator assignments to be made to schools and institutions established within the framework of cooperation agreements with domestic or foreign institutions and organizations or other countries, and carrying out national or international projects, those selected as schools and institutions applying special programs and projects with the approval of the Minister, and institutions directly affiliated with the Ministry's central organization with the approval of the Minister will be made by the Minister.
Teaching staff working at universities within the scope of the relevant article of the Higher Education Law may be given the duty of school principal within the scope of the first paragraph.
AWARD AND DISCIPLINARY PROVISIONS
Teachers and administrators may be given a certificate of achievement, a certificate of superior achievement, and an award within the scope of the Civil Servants Law.
The disciplinary provisions of the Civil Servants Law will be applied to teachers and administrators. However, among teachers and administrators; those who share audio or images related to students and education processes outside the procedures determined in the relevant legislation will be given a reprimand; those who give private lessons for a fee or direct students for private lessons other than those required by the relevant legislation, those who engage in words, behaviors, states, and actions that set a negative example for students in a way that is incompatible with the teaching profession, those who act biasedly in the evaluation of students' course success, and those who carry out activities and practices contrary to the goals and objectives determined by the curriculum approved by the Ministry in the education and training process will be given a salary deduction penalty.
Without prejudice to the relevant provisions of the Civil Servants Law, the teaching of those convicted of manufacturing and trading drugs or stimulants, facilitating the use of drugs or stimulants, purchasing, accepting or possessing drugs or stimulants for use, or using drugs or stimulants, indecent acts, obscenity and prostitution crimes, and crimes against sexual immunity, which are regulated in the Turkish Penal Code, will be terminated.
NATIONAL EDUCATION ACADEMY
A National Education Academy affiliated with the Ministry will be established to prepare teacher candidates for the profession, and to prepare, implement, and evaluate training programs for the professional development, career advancement, and promotion of teachers, administrators, and other personnel. Education and practice centers may be opened within the Academy in places deemed necessary.
The work and transactions necessary for the personnel, inspection, maintenance and repair, protection and security, movable and immovable property, tools, equipment, materials, fixtures, and vehicles, and similar needs of the Academy will be carried out by the relevant units of the Ministry. The appropriations foreseen for the expenses of the Academy will be included in the Ministry's budget.
The proposal also codifies the duties of the Academy. Accordingly, the Academy will prepare and implement preparatory training programs for the teaching profession, administrator training programs, and training programs for the career advancement and promotion of teachers, administrators, and other personnel.
The Academy will determine the competencies that teachers, administrators, and other personnel should possess and update them according to developing conditions. It will plan and implement training activities that will provide teachers with the knowledge, skills, attitudes, and values required by the teaching profession, as well as digital competencies. It will determine the training needs of teachers, administrators, and other personnel, prepare and implement training programs to meet these needs, and monitor the effectiveness of the training. If their requests are deemed appropriate, it will provide training to personnel working in private educational institutions, provided that the expenses are covered by their institutions or themselves.
If their requests are deemed appropriate, the Academy will provide training to the personnel of other public institutions and organizations, provided that the expenses are covered by their institutions or themselves. It will follow scientific and technological developments in the field of education and training; publish on subjects within its field of duty; and carry out research, development, project activities, and scientific studies. It will cooperate with domestic or foreign universities and other institutions and organizations on subjects related to its field of duty; and perform other duties to be given by the Minister.
ACADEMY MONITORING AND STEERING BOARD
The Academy Monitoring and Steering Board will consist of 7 people, including the Minister or a Deputy Minister to be assigned by the Minister as the chair, the President of the Academy, the General Manager of Private Educational Institutions, the General Manager of Personnel, a member of the Council of Higher Education, and one representative each to be determined by the Minister from other public institutions and organizations and universities.
The Board will determine policies and strategies on subjects within the Academy's field of duty; and monitor and evaluate the work carried out. The Board will meet at least twice a year, and the secretariat services of the Board will be carried out by the Academy Presidency.
The Academy Presidency will consist of the President of the Academy, the Academic Board, and service units not exceeding 10 in number. The President of the Academy, as the highest authority of the Academy, will work directly under the Minister. The President of the Academy will be responsible for the representation and management of the Academy, and the execution and inspection of Academy activities. The President of the Academy will chair the Academic Board. The Academic Board will consist of a president and 10 board members.
The Academic Board will prepare the standards regarding the implementation of policies determined by the Academy Monitoring and Steering Board on subjects within the Academy's field of duty, the competencies that teachers, administrators, and other personnel should possess, the programs of training to be organized by the Academy, and the Academy's annual work plan, and submit them to the Minister's approval. The Academic Board will examine and decide on objections made against expulsion penalties from the Academy.
The provisions of the proposal regarding the National Education Academy and the Academy Monitoring and Steering Board will enter into force on January 1, 2025.
According to the proposal, the Ministry of National Education will be able to employ education personnel within the framework of the relevant article of the Civil Servants Law to be assigned to the service units of the National Education Academy and to carry out the Academy's training activities.
If those in the staff of public institutions and organizations who are in positions subject to the said Law and in teaching staff positions subject to the Higher Education Personnel Law are employed in contracted personnel positions within the scope of this regulation, their connection with their staff will be severed.
The services of those who return to their previous institutions spent at the Academy will be evaluated in their acquired right monthly degree and step, and the periods they spent at the Academy will be considered as having passed in their own institutions in terms of other personnel transactions. No end-of-service compensation will be paid to these personnel in case of termination of the contract, and the periods they spent in contracted personnel positions at the Academy will be taken into account in the calculation of retirement bonus. Among those employed within this scope, no retirement bonus will be paid for the periods spent in their staff before being appointed to the contracted personnel position for those who retire or die while in a contracted personnel position, and these periods will be taken into account in the calculation of the end-of-service compensation to be paid.
A service contract will be signed between the person to be employed as contracted personnel within the scope of the regulation and the Minister or the President of the Academy if authorized.
The place of duty of the contracted personnel, the definitions of the work they will do within their duty, the professional and ethical rules they will follow, their duties, authorities, and responsibilities, and other matters will be specified in the service contract. The service contract will be made in writing for one year. A new contract may be signed at the end of this period. If the contract period expires, the contract period may be extended up to 3 months until a new contract is made.
COURSE FEES TO BE PAID AT THE ACADEMY
Those employed as education personnel at the National Education Academy who have the title of professor, associate professor, and assistant professor will have an obligation to teach at least 10 hours of classes per week. For their teaching duties exceeding 10 hours per week, they will be paid an additional course fee for up to 20 hours per week, provided that these teaching duties are actually performed.
Those not within this scope will be obliged to teach at least 15 hours of classes per week, and for teaching duties exceeding this period, an additional course fee payment will be made for up to 15 hours per week, provided that they are actually performed.
In return for the teaching duties they have actually performed, education personnel with the title of professor will be paid an additional course fee in the amount found by multiplying the indicator figure of 320 per course hour, those with the title of associate professor 270 per course hour, those with the title of assistant professor 220 per course hour, and those not within this scope 160 per course hour by the civil servant monthly coefficient.
Contracted personnel assigned to research, projects, publications, and similar scientific studies will be paid an additional course fee, provided that it does not exceed 5 hours per week.
ASSIGNMENT OF TEMPORARY TEACHING STAFF
Contracted personnel will not be able to do any other gainful work, will not be able to take a position as a salaried, paid, or contracted employee in any official or private institution, will not be able to engage in acts and actions prohibited for civil servants in the Civil Servants Law, and will not be able to be a member of political parties.
Contracted personnel may be assigned as administrators in the service unit where they are employed. As long as they carry out these duties, no additional fee will be paid to them for these duties.
Temporary teaching staff may be assigned to the Academy in cooperation with higher education institutions. The working period of personnel employed in this way at the Academy will be considered as having passed in higher education institutions.
Except for education personnel, those assigned to teach at the Academy on the condition of being a university graduate may be given an additional course duty of up to 30 hours per week. These personnel will be paid an additional course fee based on the indicator figures determined in the regulation, taking into account their titles, in return for the teaching duties they have actually performed.
The distribution of duties of the Academy's service units, the working procedures and principles of the Academic Board and the Academy Monitoring and Steering Board, and the procedures and principles regarding other matters regulated in this section will be determined by regulations to be issued by the Ministry.
PROTECTION OF EDUCATION WORKERS FROM VIOLENCE
The proposal also aims to protect education workers from violence.
Accordingly, the penalties to be determined for the crimes of intentional injury, threat, insult, and resisting to prevent the performance of duty within the scope of the Turkish Penal Code committed due to their duties against those working as administrators, teachers, master instructors, instructors/teachers or guidance counselors in projects carried out by the Ministry for the education of foreign students in official educational institutions affiliated with the Ministry of National Education; those working as administrators, teachers, expert instructors, and master instructors in private educational institutions; those teaching for a course fee in official educational institutions affiliated with the Ministry and private educational institutions; and teachers working in other public institutions and organizations will be increased by half. In the event that these crimes are committed, the provisions for the suspension of prison sentences will not be applied.
Permanent teachers determined to be inadequate will be admitted to training at the Academy
According to the proposal, permanent teachers who are determined to be inadequate in performing their duties within the framework of teaching profession competencies as a result of the audit and examination conducted by the Ministry inspector or education inspector will be admitted to training by the Academy. They will be re-evaluated by Ministry or education inspectors who did not take part in the first audit within the education and training period following the completion of the training organized. Those who are determined to be inadequate as a result of the second evaluation will be appointed to positions suitable for their status in the general administrative services class.
OTHER PROVISIONS
In cases where there is no provision in the regulation, the provisions of the Civil Servants Law and other relevant legislation will be applied for the personnel within the scope of this proposal, except for teacher candidates receiving preparatory training.
"Intentional injury crime committed during or due to their duties against those working as administrators, teachers, master instructors, instructors/teachers or guidance counselors in projects carried out by the Ministry of National Education for the education of foreign students in official educational institutions affiliated with the Ministry of National Education; those working as administrators, teachers, expert instructors, and master instructors in private educational institutions; those teaching for a course fee in official educational institutions affiliated with the Ministry and private educational institutions; and teachers working in other public institutions and organizations" is being added to the "reasons for arrest" in the Criminal Procedure Code.
With the regulation, a change is being made in the Social Insurance and General Health Insurance Law. Accordingly, teacher candidates admitted to preparatory training at the National Education Academy by the Ministry of National Education within the scope of the Teaching Profession Law will be considered general health insured during the period they are trained. The general health insurance premiums of these persons will be paid from the Ministry's budget over the 30-day amount of the lower limit of daily earnings subject to premium. The spouses and children, as well as mothers and fathers to be determined, of these persons will also be benefited from general health insurance in the capacity of dependents.
According to the change made in the Military Service Law, the military service of teacher candidates who have a military service obligation and are admitted to preparatory training at the National Education Academy by the Ministry of National Education within the scope of the Teaching Profession Law will be postponed during their training at the Academy upon the Ministry's proposal.
On the other hand, the Teaching Profession Law dated February 3, 2022, is being repealed by the proposal.
In the employment of contracted teachers, appointment of permanent teachers, and administrator assignments to be made until September 1, 2025, the provisions of the legislation repealed by the regulation will be applied. As of the date this provision enters into force, the duties carried out by the Ministry's General Directorate of Teacher Training and Development and given to the Academy by the proposal will continue to be carried out by the said General Directorate within the scope of the relevant legislation provisions until January 1, 2025.
CANDIDATE TEACHER TRAINING PROGRAM
According to the proposal, those who are working as candidate teachers on the date the regulation enters into force and those who will be employed as candidate teachers from the date it enters into force until September 1, 2025, in order to prepare them in the best way for the profession, civil service, the institution they work in, and the social environment they are in; will be subject to the Candidate Teacher Training Program, which consists of in-service training planned to be at least 240 course hours, including preparation for civil service and the profession, contributing to their personal and professional development, and practices where they will observe the basic duties determined based on the fields of activity of the institution they will work in and will also practice themselves under the supervision of a consultant.
The candidacy process cannot be less than one year and more than 2 years. The candidacy of candidate teachers who complete the program and complete the one-year service period will be removed at the end of the candidacy process, and they will be appointed to teaching.
Those who are working as contracted teachers on the date the regulation enters into force and have not completed the candidacy process will be subject to the candidacy process foreseen for candidate teachers. The candidacy provisions will not be applied to those who have completed the 3-year working period required by the contract among contracted teachers who have completed the candidacy process and have been appointed to the teacher staff. The periods spent in candidate teaching will be considered as having passed in teaching in the granting of expert teacher and head teacher titles.
Teachers and expert teachers who are in office on the date the proposal enters into force will be able to apply for the title of head teacher, provided that they complete a 20-year working period in teaching and/or expert teaching and meet the other conditions, excluding the condition of having at least 10 years of service in expert teaching among the determined conditions.
