Esenyurt Mayor Ahmet Özer was detained yesterday morning following searches conducted at his home.

In the evening, Özer was arrested on charges of "being a member of the PKK/KCK armed terrorist organization."

It has emerged that the investigation leading to the arrest of Esenyurt Mayor Ahmet Özer was initiated after his name appeared in digital materials seized during a search conducted on March 28, 2016, at the Diyarbakır D-Type High-Security Penal Execution Institution.

According to Alican Uludağ from DW Turkish, the arrest warrant issued by the Istanbul 7th Criminal Judgeship of Peace included the following statements:

"Considering the nature and character of the crime of 'Membership in an Armed Terrorist Organization' attributed to the suspect, the current state of evidence (the investigation was initiated upon the determination that the suspect's name appeared in the examination of digital materials obtained during a search conducted on 03/28/2016 in the ward housing detainees and convicts at the Diyarbakır D-Type High-Security Penal Execution Institution),

As a result of communication interception and physical surveillance measures applied to the suspect, it was determined through tape recordings and HTS records that he had conversations with individuals of organizational benefit; that he had conversations with the mother of a person named Mehmet Kaya, who is in prison for membership in a terrorist organization, to offer condolences upon her death, during which he made remarks such as '...she raised valuable children like you...', and that he had communication with 694 different people who have records related to the PKK/KCK terrorist organization, 47 of whom have arrest warrants, 5 of whom are in prison, 3 of whom have international arrest warrants, and one of whom is subject to a red notice,

It was determined that a magazine promoting the terrorist organization was found in the office of the Esenyurt Municipality building where the suspect serves as Mayor, and that documents evaluated as organizational were seized within a file confiscated during the same search; the conviction formed by our Judgeship that he is in a hierarchical relationship with the organization through actions exhibiting continuity, intensity, and diversity,

Considering that the suspect is the Mayor of Esenyurt, there is a suspicion of evidence tampering; taking into account the open-source research, HTS examination report, bank account statements, tape recordings, all police reports, and the suspect's defense, there is concrete evidence indicating the existence of strong suspicion that the suspect committed the attributed crime; given that the evidence has not yet been fully collected, the lower and upper limits of the penalty prescribed by law for the attributed crime, the fact that it is among the catalog crimes listed in Article 100/3-a of the Criminal Procedure Code (CMK), and the principle of proportionality, there are concrete facts giving rise to the suspicion that the suspect might flee or hide,

For these reasons, it is understood that judicial control measures would be insufficient for the suspect; therefore, the requests for release by the suspect and his defense counsel are rejected, and it is ordered that the suspect AHMET ÖZER be ARRESTED in accordance with Article 100 and subsequent articles of the CMK..."
