Botched Botox procedure ruled as 'negligent injury'

A beauty center operator in Samsun has been sentenced to a judicial fine of 1,500 Turkish Liras for the crime of "negligent injury" in a lawsuit filed following a botched Botox procedure.

Botched Botox procedure ruled as 'negligent injury'

Samsun's İlkadım district resident Zafer H., 60, visited a beauty center owned by G.G.Y., whom he knew previously, to receive Botox treatment. Dissatisfied with the initial procedure, Zafer H. returned to the beauty center shortly after for a second Botox application, which resulted in wounds forming on his face.

Following a criminal complaint filed by Zafer H., a lawsuit was initiated against G.G.Y. at the Samsun 10th Criminal Court of First Instance.

The indictment prepared by the Public Prosecutor's Office stated that, according to an expert report, complications arose because the procedure was performed by a suspect who lacked medical qualifications and was not authorized by regulations to perform such procedures.

The indictment, which noted that the suspect was deemed at fault for the action, included the following assessment:

"The mediation process between the parties concluded negatively as the complainant did not accept the settlement offer and the suspect did not respond to the properly served notification within the legal timeframe. When evaluating the complainant's statement, the suspect's testimony, the forensic report, and the expert report together, it was determined that there is sufficient suspicion to warrant a public trial, as the suspect committed the crime of 'causing injury to a person by negligence' by performing a Botox procedure on the complainant despite not being a physician, thereby causing the injury."

'EXPIRED PRODUCT...'

In his testimony during the hearing, Zafer H. stated that he had the Botox procedure done at the beauty center owned by G.G.Y., whom he knew, for 1,000 liras, adding, "As a result of the procedure, narrowing and discharge occurred on my face and right eye. Upon this, she called me and said that there were side effects because they had used an expired product. She called me back to renew the Botox procedure with new products and performed fillers around both my eyes and the corners of my lips."

G.G.Y., however, denied the accusations, claiming that she had only performed skin care on Zafer H.

G.G.Y. said, "Although Zafer H. requested Botox, I only performed skin care on him. I did not charge him any fee for this procedure. Since I did not commit the crime, I do not wish to compensate for the damages. I request my acquittal."

The court ruled that the defendant G.G.Y. committed the crime of "negligent injury" against Zafer H., sentencing her to a judicial fine equivalent to 90 days of imprisonment, which was then converted to a 1,500 lira judicial fine after considering the potential impact of the sentence on her future.
