CHP MPs could have abducted Ergenekon defendants!...

Continuing the defense he began yesterday against the opinion on the merits, former judge Hüsnü Çalmuk played the footage of those hearings from his computer to the panel before responding to the accusation that he prevented members of parliament from observing the hearings. 

Hüsnü Çalmuk, one of the critical judges of the Ergenekon conspiracy, stated that during the trials, they were concerned that the MPs who came to observe the hearing might jump from the spectator section, take the defendants, and carry them away. Çalmuk also referred to the so-called Action Plan for Combating Reactionism and the Internet Memorandum as "documents of a junta attempting to seize the government."

After the footage was viewed, Çalmuk explained the following:

"This is not a wedding hall; it is a courtroom. Defendant Mustafa Balbay, who was elected as an MP, gets up and speaks as if he were holding a rally. We want him to be removed, but no one pays attention to anyone, and the dignity of the court is overshadowed. We suffered the agony of being unable to do anything for half an hour. The spectators booed the panel and used unspeakable language. Istanbul MP Mahmut Tanal comes in and interferes with the security guards. No, we did not prevent them; we adjourned the hearing.

They also watched from the doorway while the interim decision was being announced. Footage does not lie. If we had allowed these things to continue, it would not have been a court of the Republic of Turkey, but a court of somewhere else. We attached importance to the protection of the Republic of Turkey's court. How can protecting the dignity of the court be considered a crime?

We thought about what would happen if they jumped from the spectator section, saying, 'We have immunity, no one can touch us, you cannot arrest us,' and took the defendants away. This was also an attempted coup against the judiciary. Indeed, the documents in the file mentioned wearing fur hats and raiding the Parliament with 10,000 people. We did not evaluate this in the verdict, but such a thing existed as well."

After the Presiding Judge warned, "We understand the atmosphere. The conclusion?", Çalmuk, who requested his acquittal on this charge, also spoke about the failure to investigate fingerprints on the copy of the so-called Action Plan for Combating Reactionism found in the office of one of the case's plaintiffs, retired First Lieutenant Serdar Öztürk:

"The allegations are things written in Serdar Öztürk's fantasy world. He wanted his fantasies, such as 'The police put this there,' to be investigated. Let's assume police fingerprints were found. What is the effect on our trial? Why would the police have picked it up? They think that police work with gloves on their hands, hairnets on their heads, and pocketless aprons. That only happens in American movies. If someone else's fingerprint is found on the document, will Serdar Öztürk be innocent? How can sentences from his fantasy world be made the subject of an accusation? This citizen has retired due to disability. There is no possibility of him returning to the TSK (Turkish Armed Forces). Why would we target his liquidation?"

Hüsnü Çalmuk also responded to the accusation that a new report was not obtained for the so-called Action Plan for Combating Reactionism, which is alleged to belong to Dursun Çiçek, and that evidence in favor of Çiçek was not collected:

"We obtained a report from the Council of Forensic Medicine. But they wanted the reports they obtained themselves, not ours, to be taken into account. If it is being said, 'Keep getting reports until one comes out in favor of Dursun Çiçek,' then excuse me, I will write my resignation letter and leave. The signature was made by a machine. This is an allegation that would blow up the Turkish Commercial Code.

The junta that determined Dursun Çiçek did this deleted the document from the General Staff computer. They are sure that Çiçek did it, which is why they deleted it. If you search for years for the so-called 'whistleblower officer' who sent the original of this document and worked at the General Staff, this trial will never end. There is the Internet Memorandum issue. These are truly members of a junta attempting to seize the government. And these are their documents."

As Çalmuk's defense did not conclude in today's session, the hearing was adjourned until Wednesday.
