Remarkable statement from Constitutional Court President Arslan before leaving office: 'It is a constitutional obligation'
Constitutional Court President Zühtü Arslan addressed the ongoing issue of Constitutional Court (AYM) rulings following the rights violation decision regarding imprisoned TİP Hatay MP Can Atalay and the subsequent stripping of his parliamentary status, stating, "We may not like or agree with them, but the implementation of Constitutional Court rulings is a constitutional obligation."
Despite two rights violation rulings issued regarding imprisoned TİP Hatay MP Can Atalay, Deputy Speaker of the Grand National Assembly of Turkey (TBMM) Bekir Bozdağ read out the Court of Cassation's decision to strip Atalay of his parliamentary status.
With this decision, the non-implementation of Constitutional Court rulings and the status of judicial decisions in Turkey were once again opened for debate.
Constitutional Court President Zühtü Arslan emphasized the unimplemented Constitutional Court rulings in his farewell speech before leaving office.
"YOU MAY NOT LIKE OR AGREE WITH THEM, BUT..."
Arslan stated the following:
"It does not conduct an appellate review, but a review of constitutionality. There is no legal basis or foundation for not complying with Constitutional Court rulings on the grounds that there are differences of opinion after the Court has made its decision. We may not like or agree with them, but their implementation is a constitutional obligation."
