Constitutional Court's 'constitution' response to the Court of Cassation: Release expected!

The Constitutional Court (AYM) has issued a second ruling of rights violation regarding imprisoned TİP deputy Can Atalay

"COURT OF CASSATION CAUSED A RIGHTS VIOLATION"

Following the ruling, the AYM published a press statement regarding Atalay. The statement included the following: "The process, shaped by the Court of Cassation's decision which disregarded the provisions of the Constitution, is clearly contrary to the letter of the Constitution."

The statement further added, “In conclusion, the process that began with the first-instance court sending a file within its jurisdiction to the Court of Cassation, and was shaped by a decision in which the Court of Cassation disregarded the provisions of the Constitution, has clearly violated the letter of the Constitution and ultimately led to the violation of the applicant's right to individual application, right to be elected and engage in political activity, and the right to personal liberty and security.”

RELEASE EXPECTED

The ruling has also been published in the Official Gazette, and the reasoned decision has reached the clerk's office of the 13th High Criminal Court. Atalay's release is expected.
