Eviction ruling for rental agreements exceeding 10 years

In Istanbul's Etiler district, a landlord applied to the court to evict a tenant who had been living in an apartment rented for 60 thousand lira for approximately ten years. The tenant wanted to continue living in the home, claiming that they had made payments regularly until now. However, when no positive response was received from the tenant despite a formal notice, the matter was taken to the judiciary.

The landlord's claim was based on the article in the Code of Obligations that grants the right to eviction for rental agreements that have lasted more than 10 years. In its examination, the court found the landlord to be in the right and ruled for the eviction of the tenant. The court's decision was not limited to eviction; both court costs and attorney fees were also demanded from the tenant.

THE TENANT WILL ALSO PAY ADDITIONAL FEES

In addition to the tenant vacating the property, a ruling was established for the tenant to pay the landlord 18 thousand TL in attorney fees and 5 thousand 880 TL in court costs.

According to the regulation in the Code of Obligations, when a rental agreement completes 10 years, the landlord can terminate the agreement unilaterally, provided that they inform the tenant by sending a formal notice at least three months before the end of the agreement. It was stated that in the case in question, the rules regarding time and notification were followed accordingly.

This decision serves as a guide for landlord-tenant relationships where the rental agreement has continued for 10 years or longer. Experts recommend that those in similar situations should first carefully follow the time and notification obligations in the legislation.
