IBAN regulation in the 12th Judicial Package: Separate penalty provision coming for those who let others use their accounts

A new regulation targeting those who open their bank accounts or account information for others to use is planned to be added to the legislative proposal currently under discussion in the TBMM, known publicly as the "12th Judicial Package."

With the study being prepared, it is envisioned that a separate provision will be created in the Turkish Penal Code (TCK) for individuals who pave the way for fraud crimes by sharing their account information in exchange for unfair gain.

The regulation is planned to be implemented through an amendment to Article 158 of the TCK. Accordingly, a new paragraph will be added to the article regarding those who share account information with others for the purpose of unfair gain, and an independent penalty provision will be established.

If the study is completed, the regulation is expected to be added to the text via a motion during the 12th Judicial Package discussions to be held today in the TBMM Justice Commission or during the General Assembly stage of the proposal.

It is aimed to impose penalties through the new provision for acts that can currently be evaluated under the scope of "qualified fraud," which carries a prison sentence of 3 to 10 years. It is stated that the justifications of protecting citizens exposed to fraud and effectively combating crime will be taken into account in the regulation.
