The investigation into the traffic accident in Eskişehir that resulted in the death of 3-year-old Elif Mavi Avli and the injury of her mother, Merve Avli, has been completed. The indictment prepared by the Eskişehir Chief Public Prosecutor's Office has been accepted by the 1st High Criminal Court.
A prison sentence of 2 to 15 years has been requested for the detained defendant Fatoş Akıl Bilgesoy on the charge of "causing death and injury by negligence." Bilgesoy is expected to appear before the judge in November.
THE ACCIDENT OCCURRED IN THE VİŞNELİK NEIGHBORHOOD
The accident took place on September 3 in the Vişnelik neighborhood of the Odunpazarı district. The car with license plate 26 AFU 319, driven by Fatoş Akıl Bilgesoy, struck Merve Avli and her daughter Elif Mavi Avli as they were attempting to cross the road.

Upon notification, police and medical teams were dispatched to the scene. After initial intervention, Elif Mavi was taken to a private hospital and later transferred to the Eskişehir Osmangazi University Faculty of Medicine Hospital, but she could not be saved. Her mother, Merve Avli, sustained minor injuries in the accident.
Camera footage included in the file shows the car striking Elif Mavi as she crossed the road with her mother, and Merve Avli experiencing great panic after the accident. It was also determined that Elif Mavi was dragged under the car for 14 meters.

DRIVER FOUND PRIMARILY AT FAULT IN FORENSIC MEDICINE REPORT
Bilgesoy, who was detained after the accident, was referred to the courthouse following police procedures. Initially, a judicial control decision in the form of "house arrest" was issued. Upon the prosecutor's objection to this decision, an arrest warrant was issued.

Bilgesoy, who was re-detained on September 8, was arrested by the Criminal Judgeship of Peace. The indictment stated that while the initial traffic accident report indicated the driver was at fault and the pedestrians were not, an expert report dated September 4 provided a contrary assessment.
Due to this contradiction, the file was sent to the Ankara Traffic Specialization Department of the Council of Forensic Medicine. The report concluded that Bilgesoy was primarily at fault due to her carelessness, lack of precaution, and actions contrary to the rules, and that Elif Mavi Avli and her mother were not at fault.

It was learned that Bilgesoy claimed in her statement to the prosecutor that her speed was slow during the accident. The defendant reportedly said, "A vehicle gave me way and I started to pass slowly. As I continued, I suddenly saw the child. I swerved the vehicle to the right, but the child ran towards my front and the accident occurred."
When asked about the camera footage showing her accelerating at the moment of impact and immediately before, Bilgesoy reportedly replied, "I don't remember that 5-10 second part. When the child suddenly stepped onto the road, I swerved to the right to save the vehicle. I regret the accident."
