Judicial recess begins: Which cases will be heard, and which will wait?

The judicial recess, which serves as a collective leave period for members of the judiciary, began as of today. During this process, regular hearings in courts will largely be suspended; duty courts and panels will remain in operation to ensure that judicial services are not disrupted.

Throughout the judicial recess, proceedings concerning detained defendants, reviews of detention status, applications where delay poses a risk, and judicial matters specified by law as urgent will be evaluated by duty courts. Other cases and trials will resume where they left off with the start of the new judicial year.

At the Council of State (Danıştay), a duty panel will also be on duty during the judicial recess. The duty panel will not be able to issue rulings on the merits of cases; however, it will be able to examine requests for stays of execution and urgent applications.

At the Court of Cassation (Yargıtay), two duty chambers will serve, one in the field of civil law and the other in criminal law. While the criminal chamber will handle files concerning detained defendants, the civil chamber will evaluate urgent legal matters.

The Constitutional Court (AYM) is not subject to the judicial recess practice and will continue its work without interruption. The judicial recess will end on August 31; the new judicial year will begin on Tuesday, September 1.
