In the second hearing of the case concerning the shooting deaths of Mehmet Kaya, his wife Berna Kaya, and their daughter Samyeli Kaya in their home in the Kızıltepe district of Mardin, a new video recording, stated to be from before the incident, was added to the case file. The Mardin 5th High Criminal Court ruled that the recording be sent to an expert witness for clarification and examination.
The defendants M.C., B.K., and V.E. did not attend the hearing held behind closed doors on October 23. During the hearing, where neither the defense nor the victims' attorneys were able to present their arguments, the court decided to continue the detention of the jailed defendant M.C. after a recess. The next hearing was adjourned to February 5, 2027.
Speaking to the press in front of the courthouse after the hearing, the Kaya family's attorney, Seher Acay, stated that the recording submitted to the file was from before the day of the incident. Acay noted that the perpetrators and the victims could be seen together in the footage and alleged that gold was mentioned in the recording, albeit in a low voice.
In this video, which dates back to before the day of the incident, the perpetrators and the victims are seen together, and they can be heard talking about gold, albeit in a low voice. The court has decided to send this recording to an expert witness for clarification and examination.
Acay stated that the case is not just about a grave crime against a single family, but also points to social issues such as individual armament and the tendency toward violence. "The Kaya family needs justice, and this justice will be served with a fair verdict from the court," she said.
NO WEAPON WAS FOUND AT THE SCENE
The incident occurred on November 25, 2025, in an apartment on the second floor of the Hacı Şeyhmus Can Apartment building on Mardin Street in the Turgut Özal neighborhood of Kızıltepe. Neighbors who had not heard from the family opened the door with the neighborhood headman and found the lifeless bodies of Mehmet, Berna, and Samyeli Kaya, who had been shot in the head.
Initial investigations determined that the weapon was not found in the house and that there were no signs of forced entry or a struggle. It was noted that Samyeli Kaya's body was found on the sofa, while her parents were in the middle of the room. A special team was formed within the Provincial Security Directorate to examine camera footage and take statements from neighbors and relatives.
As part of the investigation, the family's neighbor, M.C., was apprehended with the pistol believed to have been used in the incident. M.C., along with V.E. and B.K., who were alleged to have assisted him, as well as B.A., who was identified as a gun dealer, were arrested. While the file for B.A. was separated, V.E. and B.K. were released during the first hearing held on June 29.
In the indictment prepared by the Kızıltepe Chief Public Prosecutor's Office, a sentence was requested for M.C. for three separate counts of "premeditated murder." Additionally, a prison sentence of up to 15 years was requested for M.C. for possession of an unlicensed firearm and armed robbery in a residence at night. For V.E. and B.K., prison sentences of up to five years each are requested for the crime of "destroying, concealing, or altering evidence of a crime."
