According to the report in Hürriyet, a woman living in Nevşehir filed for divorce from her husband, claiming that she was subjected to violence, insults, and threats by him.
The husband, denying the allegations, filed a counter-divorce suit, claiming that his wife used birth control pills without his knowledge, was constantly on her mobile phone, and shared intimate secrets with others.
PRECEDENT-SETTING RULING FROM THE COURT OF CASSATION
The Nevşehir Family Court found both parties at fault and ruled for the couple's divorce due to the 'shaking of the foundation of the marital union.' In the court's reasoned decision, it was stated that the husband was found at fault for the violence he inflicted on his wife, and the woman was found at fault for using birth control pills secretly from her husband.
The woman, objecting to the local court's decision, took the case file to the Court of Cassation. Stating in her appeal petition that she had no fault in the shaking of the foundation of the marital union, the woman requested the reversal of the local court's decision, which she argued was contrary to procedure and law. Evaluating the request, the 2nd Civil Chamber of the Court of Cassation upheld the local court's decision.
