Gezi Park trial convict Tayfun Kahraman has issued a statement following the publication of the reasoning for the Constitutional Court's (AYM) second violation and retrial ruling regarding his case in the Official Gazette.
Stating that he is following the process through his lawyers, Kahraman indicated that the Constitutional Court has sent the cover letter regarding the implementation of the ruling to the Istanbul 13th High Criminal Court.
I expect the path to my retrial to be opened and to gain the right to prove my innocence before the court.
In his statement, Kahraman said, "Since last week, following the publication of the Constitutional Court's ruling regarding the violation of my right to a fair trial in the Official Gazette, I have been following the developments as much as the conditions I am in allow, through my lawyers."
The General Assembly of the Constitutional Court had unanimously ruled for a new violation and a retrial on April 2, 2026, in response to Kahraman's second individual application, citing that the requirements of his first violation ruling had not been fulfilled. The reasoning for the decision was also published in the Official Gazette.
In the Constitutional Court letter shared by Kahraman, it was requested that if a new case number is assigned regarding the retrial proceedings linked to the violation ruling, this information should be reported to the Court. The letter also recalled the precedent that the lower court is obligated to conduct a retrial as soon as the Constitutional Court's ruling reaches it, without waiting for an application from the parties.
MHP Deputy Chairman Feti Yıldız also evaluated the ruling, stating that the Constitutional Court said "a retrial is necessary" and added, "There is no room for debate on this."
