Acquittal for Mükremin Gezgin
Social media influencer Mükremin Gezgin has been acquitted in the trial where he was charged with "mediating the publication of obscene content." The legal process against influencer Mükremin Gezgin began with a criminal complaint filed by the Ministry of Family and Social Services. It was alleged that Gezgin committed the crimes of "indecent behavior" and "obscenity" due to a video he shared on social media in which he asked young boys, "I am a woman, aren't I?"
DETENTION AND HOUSE ARREST DECISION
Within the scope of the investigation conducted by the Ankara Chief Public Prosecutor's Office, Gezgin was detained in Ankara. In April, the duty magistrate's court sentenced him to house arrest on charges of "obscenity."
DETAILS IN THE INDICTMENT
The prepared indictment stated that the video published from the '@mukremingezgin' account on the social media platform Instagram could have a negative impact on children. It was noted that in the video, the lower part of a vest tied at Gezgin's waist was pulled up, his hip area was visible, and he was walking in this manner while speaking to those around him. It was recorded that in the video, where children's voices could be heard, he told the children, "My dears, calm down," and used expressions such as, "I am a woman, aren't I?"

In his defense included in the indictment, Mükremin Gezgin stated that he filmed such videos in response to his followers' questions of "Are you a woman?" He expressed that the outfit he wore that day could have unintentionally created a hip movement, that he had no direct contact with the children in the video, and that there was no sexual implication in the content.
DEMAND FOR UP TO 3 YEARS IN PRISON
The prosecution argued that Gezgin had specifically staged his outfit and walking style to emphasize his hip area and that he had shared the video on social media in a planned manner. For these reasons, a prison sentence of up to 3 years was requested for Gezgin for the crime of "mediating the publication of obscene content."
"ARTISTIC QUALITY" DEFENSE IN COURT
Mükremin Gezgin and his lawyer, Elif Narin Dursun, attended the first hearing held at the Ankara 42nd Criminal Court of First Instance. Dursun argued that her client's actions did not contain sexual content, stating, "This is comedy. It should be evaluated as in the example of Huysuz Virjin. Mere exposure is not enough; a sexual motive must be sought."
PROSECUTOR ALSO REQUESTED ACQUITTAL
In his opinion, the public prosecutor stated that the legal elements of the crime were not met and expressed an opinion in favor of acquittal. Gezgin, for his part, requested his acquittal, saying, "I feel like a woman and I film these videos with that feeling. There was no specifically planned content on the day of the incident. The outfit I was wearing is one of the outfits I always wear."
ACQUITTAL DECISION FROM THE COURT
The court ruled that the legal boundaries of the crime were not met and issued an acquittal for Mükremin Gezgin. With this decision, it was declared that Gezgin has been cleared of the charges against him.
