Bad news for Cem Yılmaz from the court
The Court of Cassation's 2nd Civil Chamber has issued its ruling regarding Cem Yılmaz's request to reduce the $10,000 monthly alimony he pays to his ex-wife, Ahu Yağtu, to 40,000 Turkish liras.
According to a report by Halil Sadri Yılmaz from Habertürk, the Court of Cassation upheld the decision of the Istanbul Regional Court of Justice's 38th Civil Chamber, ruling that Cem Yılmaz must continue to pay $10,000 in alimony.
UNFORESEEN INCREASE
Cem Yılmaz and Ahu Yağtu ended their 20-month marriage in 2013 through a mutual agreement. Yılmaz agreed to pay $10,000 per month for their child, Kemal. Noting that the dollar exchange rate was 2 lira and 13 kuruş at the time the divorce protocol was signed, Cem Yılmaz pointed to the rise in the dollar exchange rate and the decrease in his income during the pandemic period.
For this reason, Yılmaz filed a lawsuit in 2022, requesting that the child support be converted into Turkish liras and reduced to 40,000 liras per month. Ahu Yağtu, on the other hand, requested that Cem Yılmaz's demand be rejected, stating that expenses for the child's education and development had increased.
The Istanbul 11th Family Court partially accepted Cem Yılmaz's request, taking into account the child's needs and the unforeseen increase in the dollar exchange rate. The court ruled that the $10,000 child support be converted into Turkish liras and that Cem Yılmaz pay 70,000 liras in monthly child support.
DEEMED NOT TO BE ABOVE HIS ABILITY TO PAY
The Istanbul Regional Court of Justice's 38th Civil Chamber reviewed the local court's decision. It was recalled that Cem Yılmaz had accepted the clause in Article 4 of the protocol, which stated: "The determined alimony amount is in accordance with the economic and social conditions of the parties, and potential increases in exchange rates have been anticipated."
The ruling concluded that $10,000 was not an amount exceeding Cem Yılmaz's ability to pay, given his economic and social status.
