She called Dilan Polat a 'fraud': Prosecutor's office issues 'insult' ruling
Dilan Polat, who has been in custody for 8 months as part of an investigation into alleged money laundering, filed a lawsuit against a user who called her a 'fraud' on social media. The prosecutor's office, however, decided not to prosecute.
Dilan Polat, who has been detained in prison for a long time, filed a complaint through her lawyers regarding a follower's comment that read, "Fraud Dilan Polat, stop using your parents for agitation on television. If I tell you why your father killed your mother, your father would die of grief in prison."
According to the report by Seda Nur Günaydın from Sabah, the prosecutor's office emphasized that, in light of precedent-setting Supreme Court rulings, the word "fraud" is not considered an insult and decided not to prosecute the case, citing freedom of expression.
The prosecutor's office further stated that for the crime of insult to occur, one must attribute a concrete act or fact to a person that would damage their honor, dignity, and reputation, or make such accusations, noting that merely using offensive, harshly critical, or rude language is not sufficient to constitute the crime of insult.

Underlining that there are various precedent-setting Supreme Court rulings, the prosecutor's office explained that concepts such as "disturbing behavior," "harshly critical behavior," "rude language," and "rude and impolite style of address" are recognized, and declared that the word "fraud" does not reach the level of damaging honor, dignity, and reputation, but rather constitutes a rude style of address and does not meet the elements of the crime of insult.
