Kenan Doğulu wins 'Gençlik Marşı' lawsuit

Kenan Doğulu filed a lawsuit against the company Bay Müzik, alleging that they used his album titled 'Gençlik Marşı (1999)' on digital platforms without authorization.

According to the lawsuit filed at the Istanbul Intellectual and Industrial Property Rights Court, the artist's album was released in 1999. Doğulu held the rights to the songs on this album.

It is alleged that the music company Bay Müzik used the work in question on digital music platforms such as YouTube, Spotify, and Apple Music without permission.

'SUFFERED INDESCRIBABLE DAMAGE'

The petition highlighted the following details: “The defendant company has no rights or authority over the album in question. By publishing the album in question on digital music platforms without authorization and unlawfully, the defendant has caused the client to suffer indescribable damage. We request that this unlawful act by the defendant be ended, and that the unfair infringement be stopped, prevented, and eliminated.”

COURT BLOCKS USE

According to the report in Hürriyet, the verdict was announced in the case that had been ongoing for two years at the Istanbul Intellectual and Industrial Property Rights Court.

Accepting Kenan Doğulu's case, the court ruled that the famous singer holds neighboring rights arising from his status as a performing artist over the work known as 'Gençlik Marşı' (Dağ Başını Duman Almış), which was the subject of the lawsuit.

Stating in its decision that the defendant company, Bay Müzik, published the album in question as a video clip on digital platforms and communicated it to the public without obtaining permission from Kenan Doğulu, the court decided to prevent and stop the defendant's unfair infringement.
