Khedive Palace remains under IMM ownership

A ruling has been issued in the legal battle initiated by the Istanbul Metropolitan Municipality (IMM) regarding the Khedive Palace. The IMM filed an appeal against the first-instance court's decision, which had ordered the registration of the Khedive Palace in the name of the foundations. The 1st Civil Chamber of the Istanbul Regional Court of Justice overturned the first-instance court's decision and accepted the IMM's appeal.

Khedive Palace remains under IMM ownership

The Istanbul 2nd Regional Directorate of Foundations filed a title deed cancellation and registration lawsuit against the Istanbul Metropolitan Municipality (IMM) on May 5, 2014, seeking the cancellation of the title deed for the area where the Khedive Palace is located and its registration in the name of their institution pursuant to Article 30 of the Law on Foundations No. 5737.

The Beykoz 2nd Civil Court of First Instance decided to accept the lawsuit on March 18, 2021, and ruled for the registration of the Khedive Palace in the name of the foundations.

LEGAL BATTLE BEGAN

The IMM took the decision regarding the Khedive Palace to the appellate court through its legal counsel. The 1st Civil Chamber of the Istanbul Regional Court of Justice reviewed the case and reached a verdict.

The ruling cited Article 30 of Law No. 5737, reminding that the issue of whether only 'foundation cultural assets created through foundation means' should be transferred to their respective foundations must be clarified, and that a decision should be made within the framework of the conclusion reached.

It was stated that these points were disregarded by the first-instance court.

KHEDIVE PALACE RULING

With this decision, the first-instance court's ruling was definitively overturned in favor of the IMM.

With the appellate decision, the Khedive Palace remains under the ownership of the IMM.
