Prosecutor seeks up to 3 years in prison for Mabel Matiz

While Mabel Matiz did not attend the hearing at the Istanbul 54th Criminal Court of First Instance, lawyers for both parties were present. The lawyer for the Ministry of Family and Social Services, in their statement, requested that the defendant be punished on the grounds that the elements of the crime of 'obscenity' were present in the song. The defendant's lawyers requested time from the court to prepare their defense.
UP TO 3 YEARS IN PRISON REQUESTED
Presenting their final opinion on the merits during the hearing, the public prosecutor requested that the defendant Fatih Karaca be sentenced to between 6 months and 3 years in prison for the crime of 'publishing obscene images, writings, or words through press and media'.
TIME GRANTED TO PARTIES
Announcing its interim decision, the court ruled to grant time for the parties to prepare their defense and statements against the presented opinion, and adjourned the hearing. The court is expected to announce its verdict at the next session.
FROM THE INDICTMENT
The indictment prepared by the Istanbul Chief Public Prosecutor's Office stated that the lyrics of the song "Perperişan" by the suspect Karaca create erotic connotations through bodily and spiritual metaphors that indirectly incite sexual desire, that descriptions regarding sexual intercourse are made, and that these descriptions and lyrics can be easily understood by everyone.
It was stated that the lyrics pose a danger in terms of the protection of children.
The prepared indictment noted that this song was shared openly on social media with the suspect's consent and approval, that no age restriction was applied to the broadcasts made via these digital platforms, and that it therefore poses a danger to public order and the protection of children.
It was conveyed that, especially when looking at the integrity of the meaning of these two sentences, it does not support the suspect's defense.
The indictment also recorded that the fact that it was published on platforms accessible to children caused the crime attributed to suspect Karaca to be considered in its qualified form; although the suspect did not accept the accusation in his statement and claimed that he used the phrase 'diyo şeytan üstüne atla da sal kuşu hanesine' to mean sending a message to the house of the person he loves, it was noted that when looking at the song as a whole and especially at the integrity of the meaning of these two sentences, it does not support the suspect's defense.

In the prepared indictment, it was requested that the suspect Fatih Karaca be sentenced to between 6 months and 3 years in prison for the crime of 'mediating the publication of obscene content'.
