Defendant who killed his father sentenced to 17 years in prison

The incident occurred on April 5, 2024, on Tahran Street in the Başharık neighborhood of the Battalgazi district. According to allegations, 23-year-old Mert Mutlu stabbed his 55-year-old father, Mahmut Nedim Mutlu, with whom he lived and who was divorced from his mother, after an argument between them escalated at home.

During the trial held at the Malatya 4th High Criminal Court, a report was obtained from the Elazığ Mental and Nervous Diseases Hospital to determine whether the defendant was of sound mind. The report prepared by the hospital stated that the defendant lacked criminal liability.

However, the report prepared by the Council of Forensic Medicine expressed the opinion that Mert Mutlu did possess criminal liability.

Upon the objection of the defendant's lawyer, the file was sent to the General Assembly of the Council of Forensic Medicine. The report prepared by the General Assembly also stated that the defendant, who was noted to have been receiving treatment for a mental disorder since the age of 7, possessed criminal liability.

After the deficiencies in the file were addressed, the court panel announced its verdict, sentencing Mert Mutlu to aggravated life imprisonment for the crime of intentional killing. The court concluded that the provisions for unjust provocation were met in the incident and reduced the sentence to 17 years in prison.
