Proverb comes true: Three years in prison for man who urinated on gendarmerie wall

In Aksaray, Polat K., who went to the gendarmerie command to visit a friend who had been in a traffic accident, urinated on the gendarmerie's wall on his way out.

According to the report by Özgür Cebe from Sözcü, 19-year-old Polat K., who works as a tile setter in Aksaray, went to the provincial gendarmerie command on April 16 to visit a friend who had been in a traffic accident. Afterwards, as he was leaving the guardhouse, he suddenly felt the need to relieve himself, and since there were no toilets nearby, he urinated on the perimeter wall where a parked vehicle was located. Everything happened after that. The sentry on duty, Private Furkan A., saw the incident and immediately reported the situation to his superiors.

When the duty non-commissioned officer, Ramazan G., also reported the situation to the prosecutor's office, Polat K., who had urinated on the wall of the Gendarmerie Command building, was apprehended by the police upon the prosecutor's instructions.

I HAD NO OTHER CHOICE

In his statement while being questioned at the police station, Polat K. said, "I was informed about the accusations against me at the police station. I want to give my statement without requesting a lawyer. I work as a tile setter. On the day of the incident, I went to the Provincial Gendarmerie Command to see my friend who had been in a traffic accident. I felt the need to relieve myself at the entrance of the Gendarmerie Command guardhouse. I looked around, but I couldn't find a nearby place to use the toilet. Since I live in a village, I don't know the city center very well. Because of my situation at that moment, I urinated on the wall of the provincial gendarmerie station. I am very sorry for this incident; this is all I have to say."

"I SAW HIM URINATING WITH HIS BACK TURNED TO US"

The statement of Private Furkan A., who was on duty at the No. 2 guardhouse entrance of the command, was also taken as a witness. In his statement, the sentry said, "I serve as a private at the Aksaray Provincial Gendarmerie Command. On the day of the incident, while I was leaving the guardhouse gate for official business with my commander, Ramazan G., I saw a person named Polat K. urinating on the wall belonging to the Provincial Gendarmerie Command at the entrance of the No. 2 guardhouse with his back turned to us. Together with my commander, we went to the person and told him that his action was not right. My commander also told him that he could go to the gas station right across the road to use the toilet and that it was not right to urinate on the wall. Polat K. apologized to both of us. Later, we went to the Central District Gendarmerie Station Command with my commander to process the individual. After providing the necessary information to the duty prosecutor at the courthouse and following a phone conversation, we came to the Aksaray Police Station to carry out the necessary procedures regarding Polat K. This is all I have to say about the incident."

"I WARNED HIM AND HE APOLOGIZED"

Duty station commander Ramazan G. stated in his testimony to the police, "I was serving as the duty personnel processing non-commissioned officer at the Aksaray Provincial Gendarmerie Command on the day of the incident. On the day of the incident, I saw Polat K. urinating on the command's wall with his back turned to me. I went to him and warned him that what he was doing was not right. He apologized to me. Later, we went to the Central Command to have official proceedings carried out. After informing the duty prosecutor, we came to the police station to file a complaint."

ENTERED INTO THE EVIDENCE FILE

After the police added photos of the wall, which showed the area and that the wall was wet due to urine, to the file as evidence in the summary of proceedings they prepared, they sent the documents to the Aksaray Chief Public Prosecutor's Office. A lawsuit was filed against Polat K. in the criminal court of first instance, seeking up to 3 years in prison for the crime of "damaging public property" under Article 152/1-a of the Turkish Penal Code (TCK). The indictment requested that, along with the sentencing of the defendant, he be deprived of certain rights (the right to vote and be elected) in accordance with Article 53/1 of the TCK.

IT IS REQUESTED ON BEHALF OF THE PUBLIC THAT HE BE TRIED AND PUNISHED

It was noted that the phrases "suspect's confession, detection report, witness statements, criminal record, population registration, and the entire scope of the file" were added to the evidence section of the indictment. The indictment stated:

It is understood from the suspect's confession and witness statements that the suspect Polat K., whose identity information is clearly written above, committed the crime of damaging property by soiling and polluting public property by urinating on the wall of the building belonging to the gendarmerie command located in the Aksaray city center on the day of the incident. It is requested on behalf of the public that the suspect be tried and punished in accordance with the aforementioned referral articles for the charged crimes, and that the security measures regulated in Article 53 of the TCK be applied to the suspect. The trial of the defendant will begin after the judicial recess.
