Teacher who struck and killed 7-year-old student in schoolyard accident released

Ordu 5th Criminal Court of First Instance, in the hearing held on October 31, had decided to continue the detention of the defendant Banu Kaya (46), who was sentenced to 4 years, 5 months, and 10 days in prison for the crime of "causing death by conscious negligence."

Following this, the defendant's lawyer and the prosecutor separately submitted petitions to the Ordu 1st High Criminal Court objecting to the detention.

Evaluating the request, the court decided to release defendant Kaya, taking into account the possibility of a change in the nature and classification of the crime charged and the time she had spent in detention, and imposed a travel ban on her.

Yakup Arslan, the father of Miray Arslan, who lost her life in the accident, stated in his remarks that they were deeply hurt and that they were worn down by the decision rendered.

Stating that they would file a criminal complaint against both the prosecutor and the judges of the 1st High Criminal Court, Arslan expressed that they would not let the matter drop.

BACKGROUND OF THE INCIDENT

On September 2, teacher Banu Kaya, who worked at Gazi Primary and Secondary School in Saray Neighborhood, struck student Miray Arslan, who had come to school as part of the orientation week, while entering the schoolyard with her car, license plate 52 BK 790.

The child, who was seriously injured, lost her life at the Ordu Training and Research Hospital, where she had been taken by 112 Emergency Health teams.

In the fourth hearing held at the Ordu 5th Criminal Court of First Instance, it had been decided that the defendant be sentenced to 4 years, 5 months, and 10 days in prison for the crime of "causing death by conscious negligence" and that her detention continue.

The court panel had also decided to ban Kaya from using her driver's license for a period of 2 years due to her behavior contrary to the duty of care required by traffic regulations.
