Yeni Şafak targets Constitutional Court members! 'They opened the door to FETÖ and PKK'
The newspaper Yeni Şafak, known for its proximity to the government, has targeted the members of the Constitutional Court who ruled for the release of Gezi prisoner and TİP Hatay MP Can Atalay by publishing their photos under the headline 'They opened the door to FETÖ and PKK'.
The repercussions continue following the decision by the 3rd Criminal Chamber of the Court of Cassation not to implement the 'rights violation' ruling issued by the Constitutional Court (AYM) for TİP Hatay MP Can Atalay, and its filing of a criminal complaint against the AYM members.
FULL SUPPORT FOR THE COURT OF CASSATION FROM ERDOĞAN
AKP Chairman and President Recep Tayyip Erdoğan, expressing full support for the Court of Cassation in the judicial crisis that has dominated Turkey's agenda, had stated: "First and foremost, no one can deny that the Court of Cassation is a high court. Unfortunately, the Constitutional Court has reached a point where it makes many mistakes one after another. This saddens us deeply. As of now, the decision taken by the Court of Cassation can never be cast aside or pushed away."
The Presidency of the Court of Cassation, which issued a statement yesterday evening, directed harsh accusations at the Constitutional Court and defended the 3rd Criminal Chamber. In its statement, the Presidency of the Court of Cassation said: "It is making grave decisions that will drag the legal system into chaos and is ignoring the will of the constitutional framer!"
While debates intensified following the Chamber's decision and the criminal complaint, the pro-government newspaper Yeni Şafak also targeted the AYM members who voted for the release of Atalay with a 'rights violation' opinion by publishing their photos.
YENİ ŞAFAK CLAIMS "AYM MEMBERS WOULD GRANT IMMUNITY TO GÜLEN AND KARAYILAN"
Sharing the photos of the AYM members who signed the 'rights violation' opinion with the claim that "they opened the door to FETÖ and PKK," Yeni Şafak alleged in its news text that the targeted AYM members "would grant immunity to Fethullah Gülen or Murat Karayılan if they were to run for office and be elected."

In the Yeni Şafak report, it was stated: "According to the rights violation decision regarding Atalay; if the ringleader of the Fethullahist Terrorist Organization (FETÖ), Fethullah Gülen, were to run for MP from Erzurum and win, the Constitutional Court would ignore the treacherous coup attempt of July 15 and, on top of that, grant immunity to the terrorist leader. Or, if one of the ringleaders of the PKK terrorist organization, Murat Karayılan, were to run for MP from Şanlıurfa and win, the Constitutional Court could, if it so desired, bring the terrorist into the Grand National Assembly and grant him immunity as well. The court had also issued a 'rights violation' decision for the imprisoned former HDP Co-Chair and terror convict Selahattin Demirtaş."

According to the report in T24; however, Yeni Şafak, while presenting its own claim, did not include the information that a parliamentary candidacy is only possible with the approval of the Supreme Election Council and that Can Atalay was elected as an MP after receiving this approval.
COURT OF CASSATION 3RD CRIMINAL CHAMBER HAD SAID, "GÜLEN, KARAYILAN, BAYIK COULD ALSO ENTER PARLIAMENT"
Yeni Şafak's claim regarding Gülen and Karayılan is based on the decision of the 3rd Criminal Chamber of the Court of Cassation. In its decision dated November 8, the Chamber repeated the same interpretation by referring to its previous ruling regarding Atalay as follows:
“It has been concluded that saying Article 14 of the Constitution is not suitable for interpretation in a way that ensures certainty and predictability through the decisions of judicial bodies is inaccurate, and that the crimes written in Articles 302, 307, 309, 311, 312, 313, 314, 315, and 320, as well as the first paragraph of Article 310 of the Turkish Penal Code (TCK), must be evaluated within the scope of Article 14 of the Constitution. Otherwise, Fethullah Gülen, Şerif Ali Tekalan, Recep Uzunallı, Adil Öksüz, Ekrem Dumanlı, Cemil Bayık, who are linked to many bloody terrorist acts and are subject to investigation or prosecution for the absolute terror crimes listed above, and who have not yet been captured and are sought with red notices, would be able to...
