Call to the Minister of Justice from Ahmet Zeki Üçok

Retired Military Judge Ahmet Zeki Üçok, Head of Law and Justice Policies of the IYI Party, reacted to the Istanbul 13th High Criminal Court for sending the file to the Court of Cassation despite the Constitutional Court's (AYM) ruling of rights violation regarding Workers' Party of Turkey (TIP) Hatay MP Can Atalay. Üçok also issued a call to Minister of Justice Yılmaz Tunç via his social media account. 

Üçok wrote the following:

On 06.03.2014,

SPECIAL AUTHORIZED COURTS that heard terrorism cases were ABOLISHED by the Grand National Assembly of Turkey (TBMM) with the "Law on Amendments to the Anti-Terror Law and the Criminal Procedure Code and Certain Other Laws" numbered 6526. 

On 10.03.2014,

The ISTANBUL 13TH HIGH CRIMINAL COURT, which was conducting the trial in the Ergenekon case,

by saying "THE REGULATION MADE BY THE TBMM IN THE FORM OF CLOSING THE COURTS IS A USURPATION OF THE AUTHORITY GRANTED TO THE HSYK. Requesting the implementation of the law constitutes an order contrary to the law according to the 1st paragraph of Article 137 of the Constitution," DISREGARDED THE LAW ENACTED BY THE TBMM regarding the closure of special authorized courts, continued its duty, and

RESISTED THE RIGHTS VIOLATION RULING ISSUED BY THE CONSTITUTIONAL COURT

and REJECTED THE RELEASE REQUEST OF 67 PEOPLE.

On 10.03.2014,

THE MINISTER OF JUSTICE OF THE PERIOD

BEKİR BOZDAĞ,

“IN A STATE OF LAW, NO ONE PERFORMING A JUDICIAL DUTY HAS THE RIGHT TO SAY ‘I DO NOT RECOGNIZE THIS LAW.’ THEY DO NOT HAVE THE RIGHT TO SAY ‘I DO NOT COMPLY WITH THIS LAW, I DO NOT APPLY IT.’ 

They absolutely have no right or authority to usurp authority and take other steps by placing themselves in the position of a legislator and enacting laws. I would like to express this here specifically. 

I AM ALSO CALLING THE HSYK TO DUTY ON THIS MATTER. 

REGARDING THE JUDGES WHO DO NOT RECOGNIZE THE LAW, 

DO NOT RECOGNIZE THE STATUTES, 

DO NOT RECOGNIZE THE CONSTITUTION, 

DO NOT RECOGNIZE THE LEGISLATION, THE HSYK MUST TAKE THE NECESSARY LEGAL ACTIONS. I WOULD LIKE TO EXPRESS SPECIFICALLY THAT I AM CALLING THE AUTHORIZED CHAMBER OF THE HSYK TO DUTY FROM HERE.” he stated.

In 2014,

The judges of the Istanbul 13th High Criminal Court, Hasan Hüseyin Özese, Sedat Sami Haşıloğlu, and Hüsnü Çalmuk, were all FETO MEMBERS. 

THEY RECOGNIZED NEITHER LAW 

NOR STATUTES 

NOR THE CONSTITUTIONAL COURT RULING.

THEY ALL RECEIVED SENTENCES AND WERE PUT IN PRISON, AND WERE DISMISSED FROM JUDGESHIP.

YOU RECOGNIZE NEITHER LAW,

NOR STATUTES,

NOR THE CONSTITUTIONAL COURT RULING?

BY SENDING THE FILE YOU ARE SUPPOSED TO RULE ON TO THE COURT OF CASSATION, YOU ARE DRAGGING OUR COUNTRY INTO CHAOS.

Like your predecessor Bekir Bozdağ,

WILL YOU CALL THE HSK AUTHORIZED CHAMBER TO DUTY REGARDING THE MEMBERS OF THE ISTANBUL 13TH HIGH CRIMINAL COURT WHO DO NOT RECOGNIZE LAW, STATUTES, OR THE CONSTITUTIONAL COURT RULING? 

OR WILL YOU CONTINUE TO BE A PART OF THIS CHAOS BY REMAINING A SPECTATOR TO THE DESTRUCTION OF THE TURKISH JUDICIARY?
