A message from MHP's Feti Yıldız regarding the IMM operations? 'The presumption of innocence is the most fundamental right'

Feti Yıldız, Deputy Chairman of the Nationalist Movement Party (MHP) and known for his legal background, made evaluations regarding the debates on effective remorse, statements, and evidence that have recently occupied the public agenda in an interview with Türkgün Newspaper. Although he did not explicitly mention the name, Yıldız's statements touched upon topics directly related to the investigation into the Istanbul Metropolitan Municipality.

Responding to questions from the newspaper's Editor-in-Chief Mehmet Müftüoğlu, Yıldız emphasized that confessions and statements, which are frequently debated in the public eye, cannot be accepted as absolute evidence, stating, "It is different for something to be evidence and for it to be accepted as evidence. The statement of a person taken into custody is both a means of defense and a means of evidence."

THE CONDITION OF LEGALITY

Stating that evidence obtained through unlawful means has no validity, Yıldız said, "Material truth must only be reached through evidence that is in accordance with the law. Evidence obtained unlawfully is null and void." These words were interpreted as a reminder, especially regarding investigations that are alleged to be conducted in a manner "far from a legal basis."

Yıldız defined the concept of "unlawfulness" with the following expressions:

"This concept covers all practices that are contrary to international conventions, laws, statutes, regulations, decisions to unify jurisprudence, and customary law, starting with the constitution."

Evaluating the practices of effective remorse, Yıldız stated that criminals can cooperate with judicial authorities regarding the crimes they have committed, and that this process can lead to a reduction in sentencing. However, emphasizing that justice should be the basis in this process, Yıldız underlined the presumption of innocence.
