AKP member questions Capital Markets Board on late decision during fund law negotiations: 'Couldn't they have acted sooner?'

During the deliberations on the Draft Law on Certain Investment Funds Decided to be Liquidated at the TBMM Planning and Budget Committee, the oversight and investigation processes regarding the fund crisis were discussed. The committee convened under the chairmanship of AKP Samsun Deputy Mehmet Muş.

Deputies who took the floor on the proposal as a whole raised concerns regarding the grievances experienced through investment funds, whether institutions took timely action, and the political-administrative dimensions of the process.

AKP Uşak Deputy İsmail Güneş noted that Treasury and Finance Minister Mehmet Şimşek made a statement on the matter on November 4, 2025, and that the Financial Stability Committee also made a decision in December, while recalling the decision taken by the Capital Markets Board (SPK) on August 28.

Güneş directed the following questions to the SPK: "What is the reason for you taking this decision so late? Couldn't they have acted sooner? On the other hand, especially while these small-cap stocks were increasing in value very rapidly in a very short time, did Borsa İstanbul suspect this and take the relevant steps, or did it not?"

Stating that not everyone who invests in funds can be declared guilty, Güneş expressed that the process might not constitute a crime for individuals who have no relationship with portfolio managers and who invest without receiving insider information. However, Güneş stated that for politicians and bureaucrats, ethical debates could arise even if the actions were legal.

EMPHASIS ON OVERSIGHT AND TRANSPARENCY IN THE COMMITTEE

Antalya Deputy Cavit Arı said that similar crises could occur in situations where trust in justice is weakened and practices are shaped according to individuals. Arı argued that if timely warnings had been taken into account, the grievances would not have reached this scale.

CHP Denizli Deputy Gülizar Biçer Karaca stated that a parliamentary commission should be established in the TBMM regarding the issue. Pointing to the Parliament's oversight duty, Karaca said that the political extensions of the crisis could also be uncovered through a commission to be established.

Manisa Deputy Ahmet Vehbi Bakırlıoğlu also reported that he had received complaints regarding funds that are not within the scope of liquidation but are stated to be under blockage. Reminding that approximately 455 thousand people were affected by the fund crisis, Bakırlıoğlu requested that the number of funds whose transactions were halted and which were not taken into liquidation be disclosed.

DEM Party Mardin Deputy Kamuran Tanhan claimed that the issue had been known for years and criticized the practices toward journalists during the investigation process. Tanhan stated that a transparent investigation should be conducted and those responsible should be brought to justice.
