The Ministry of National Defense has applied to the Appellate Court to overturn the cancellation decision regarding Deniz Demirtaş, one of the lieutenants dismissed for chanting the slogan "We are the soldiers of Mustafa Kemal."
The Ministry of National Defense (MSB) has taken the court decision that canceled the dismissal of Lieutenant Deniz Demirtaş from the Turkish Armed Forces to a higher judicial authority. In the application made by the Ministry, it was requested that the cancellation decision issued by the Ankara 21st Administrative Court be overturned.
COURT HAD UNANIMOUSLY CANCELED THE DISMISSAL PENALTY
The Ankara 21st Administrative Court had unanimously canceled the "dismissal from the Armed Forces" penalty in the lawsuit filed by Deniz Demirtaş, one of the five lieutenants dismissed from the TSK for crossing their swords and chanting "We are the soldiers of Mustafa Kemal" following the official graduation ceremony of the Military Academy on August 30, 2024.
The court concluded that the legal basis for the actions attributed to Demirtaş had not been sufficiently demonstrated.
DISCIPLINARY INVESTIGATION HAD BEEN OPENED AGAINST 5 LIEUTENANTS
Following the public emergence of footage showing the lieutenants crossing their swords and chanting slogans after the graduation ceremony on August 30, 2024, a disciplinary investigation was launched by the Ministry of National Defense.
The High Disciplinary Board of the Land Forces Command had decided to dismiss the five lieutenants on the grounds that the act in question "damaged the discipline and reputation" of the Turkish Armed Forces. This decision had caused widespread repercussions in the public eye.
"BEHAVIOR HINDERING SERVICE" NOT FOUND CONCRETE
In the decision of the Ankara 21st Administrative Court, it was stated that the act of "engaging in behavior hindering service" attributed to Lieutenant Deniz Demirtaş could not be demonstrated in a concrete, clear, and distinct manner. For this reason, it was concluded that the dismissal decision of the Ministry of National Defense Land Forces Command High Disciplinary Board, dated January 16, 2025, and numbered 2025/23, was not in accordance with the law.
The Ministry of National Defense has appealed the court's cancellation decision, moving the file to the higher court. In the application, it was requested that the canceled dismissal decision be reinstated.
