CHP prepares to apply to the Constitutional Court for Can Atalay
The CHP will apply to the Constitutional Court (AYM) tomorrow, requesting a ruling that the revocation of the parliamentary membership of Workers' Party of Turkey (TİP) Hatay MP Can Atalay is null and void.
The CHPwill apply to the Constitutional Court tomorrow with the request that "the revocation of Can Atalay's parliamentary membership, which occurred through the reading of the letter from the 3rd Criminal Chamber of the Court of Cassation in the Grand National Assembly of Turkey (TBMM) General Assembly, be declared null and void, and that the de facto change in the Rules of Procedure resulting from this be annulled." The application will be submitted to the Constitutional Court.
PRESS STATEMENT TO BE HELD
CHP Group Deputy Chairman Gökhan Günaydın will submit the party's application to the Constitutional Court. Günaydın will hold a press conference in front of the Constitutional Court before the submission.
WHAT HAPPENED?
Despite two separate rulings of rights violations issued by the Constitutional Court, the decision of the 3rd Criminal Chamber of the Court of Cassation regarding Can Atalay, a convict in the Gezi Park case, was read out in the Grand National Assembly of Turkey (TBMM) General Assembly on January 30.
Bekir Bozdağ stated, "The parliamentary membership of Hatay MP Şerafettin Can Atalay has been revoked, following the presentation of a finalized court decision that constitutes an obstacle to being elected as an MP under Article 76 of the Constitution, in accordance with the second paragraph of Article 94 of the Constitution."
With Bekir Bozdağ reading the decision, Atalay's parliamentary membership was revoked.
In a statement made on the X social media account of the TBMM General Assembly, it was noted, "The letter from the 3rd Criminal Chamber of the Court of Cassation regarding the final conviction of Hatay MP Şerafettin Can Atalay was presented for information. As a result of the letter read, Şerafettin Can Atalay's parliamentary membership has been revoked in accordance with the second paragraph of Article 84 of the Constitution."
