CHP responds to Mehmet Uçum on 'constitution'! 'Even though he has no constitutional authority...'

CHP responds to Mehmet Uçum on 'constitution'! 'Even though he has no constitutional authority...'

Republican People's Party (CHP) Deputy Chair responsible for the Ministry of Justice and İzmir MP Gökçe Gökçen issued a written statement regarding the constitutional amendment debates brought to the agenda by the AKP government.

RESPONSE TO MEHMET UÇUM

Stating that Mehmet Uçum, Deputy Chair of the Presidential Legal Policies Board, claimed that the Constitutional Court (AYM) creates problems and is not binding, Gökçen said, "Mehmet Uçum, despite having no constitutional authority, is using the power of the Presidency to instruct the judiciary to perform acts that are contrary to the constitution."

Recalling the process experienced by Can Atalay, who was not released and whose parliamentary membership was revoked despite the Constitutional Court issuing two rulings of rights violations, Gökçen stated, "Normative review decisions are no exception to this, nor are individual application decisions. The 3rd Criminal Chamber of the Court of Cassation is no exception to this. Can Atalay, the MP elected by the people of Hatay, is no exception to this. Those who claim that individual application decisions are not binding are making an interpretation that is not written anywhere in the constitution, is clearly contrary to the written text of the constitution, and is extremely dangerous for the future."

"A CONSTITUTIONAL AMENDMENT CANNOT BE MADE IN AN ENVIRONMENT WHERE THE CONSTITUTION IS NOT APPLIED"

Stating that a constitutional amendment is only possible in an environment where freedom of expression exists, different views can be debated, and a social consensus is sincerely sought, Gökçen included the following assessments in her statement:

"The government, with all its elements, declares a segment of society as an enemy, bans even commemoration events on the first anniversary of the earthquake, bends and twists the law to ensure court decisions are not followed, and threatens the earthquake-stricken public based on their choices in the election, clearly revealing its preference. A constitutional amendment cannot be made in an environment where the constitution is not applied. Regulations contrary to the unchangeable articles of the constitution cannot be made under any circumstances. Opening a constitutional amendment to debate under these conditions is to be a partner in a coup against the constitutional order."
