Court rejects Demirtaş's requests in Kobane trial
The court conducting the monthly detention review for the Kobane trial case has decided to continue the detention of the politicians being tried. The court also rejected the requests made by Selahattin Demirtaş.
A monthly detention review was conducted for the Kobane trial case, in which 108 politicians, including former Co-Chairs and Central Executive Committee (MYK) members of the Peoples' Democratic Party (HDP), 18 of whom are in custody, are being tried on the grounds of the protest actions that took place on October 6-8, 2014, against ISIS's attacks on Kobane.
REQUESTS REJECTED UNANIMOUSLY
According to the report by the Mesopotamia News Agency, the panel of the Ankara 22nd High Criminal Court, which is hearing the case, uploaded its decisions regarding the detention review to the National Judiciary Informatics System (UYAP).
The court unanimously rejected all requests for the release of those being tried in custody and for the removal of judicial control measures for those being tried without detention.
The justification provided was that "the existence of concrete evidence indicating a strong suspicion of crime is proportionate to the alleged crime, and that judicial control provisions would remain insufficient given the facts that raise a concrete suspicion that the defendants might flee."
CONTINUATION OF DETENTION
In its decision, which evaluated each detainee individually, the court panel also rejected the request by former HDP Co-Chair Selahattin Demirtaş to have all speeches made by himself and other defendants who previously held parliamentary status under the roof of Parliament brought into the case file, and to obtain an expert report regarding legislative immunity as stipulated in Article 83 of the Constitution, on the grounds that "the existing speech records are considered sufficient."
