İlhan Uzgel's Mecca Agreement challenge: The only document consists of a one-page declaration

YENI Party's Prof. Dr. İlhan Uzgel made statements on his social media account regarding the Mecca Agreement signed between Saudi Arabia, Pakistan, and Turkey. Drawing attention to the scope of the text released to the public, Uzgel directed questions to the government regarding the details of the agreement.

In his post, Uzgel stated, "As of now, as confirmed by the Pakistani ambassador in Ankara, the only document shared with the public regarding the Mecca Alliance Agreement consists of a one-page declaration." Uzgel asked, "Is there another text that regulates the military, technical, and institutional aspects of the agreement?"

EMPHASIS ON TBMM APPROVAL

Stating that the agreement directly concerns Turkey's security, Uzgel argued that the text contains an alliance provision similar to NATO's Article 5. For this reason, he stated that the process should be brought to the Grand National Assembly of Turkey (TBMM) for approval under Article 90 of the Constitution.

Uzgel claimed that there are no provisions in the agreement text regarding institutional structures such as committees and a secretariat, and said it is unclear on what articles the sub-units were established. He expressed that the effort to institutionalize the agreement without TBMM approval could create problems for the approval processes of future international agreements.

Criticizing the holding of a subcommittee meeting in Istanbul, Uzgel argued that it is unlawful to treat a text as if it were in force when it has not been approved by the TBMM or published in the Official Gazette.

Uzgel also pointed to procedural rules regarding the binding nature of international agreements, stating that if the text qualifies as an international agreement, it should be registered with the United Nations. Stating that there is no public record of such registration, Uzgel expressed that this situation raises questions about the legal existence of the agreement.

Touching on the security dimension in his post, Uzgel stated that alliance agreements are texts that mutually commit states to their security. Arguing that Turkey is being faced with the risk of being made a direct party to regional conflicts, Uzgel assessed that "strategic ambiguity is a security vulnerability in diplomacy."
