Intensive work in the Turkish Parliament for the execution regulation

The AKP has briefed the executives of the parties in the Turkish Parliament regarding the execution package it is working on. In this context, two omnibus bill proposals, including regulations annulled by the Constitutional Court, and the execution package, which is eagerly awaited by the public, were discussed. The AKP is expected to submit the execution regulation to the Turkish Parliament on Monday in order to pass it before the holiday.

DETAILS OF THE EXECUTION PACKAGE

The draft execution package prepared by the AKP includes issues such as the COVID regulation regarding crimes committed before July 31, 2023, the release of the sick and elderly, and home confinement for pregnant convicts. Furthermore, in order to eliminate the perception of impunity, it is planned that those sentenced to less than 2 years in prison will serve their sentences at a rate of 1/8 or 1/10.

CONSTITUTIONAL COURT'S ANNULMENT DECISION

The Constitutional Court had annulled the regulations in Articles 220 and 314 of the Turkish Penal Code concerning the punishment of "those who commit crimes on behalf of an organization without being a member of the organization." This annulment decision will be addressed in the new omnibus bill proposal, and regulations will be made in line with the Constitutional Court's reasoning.

MEETING AND SEARCH FOR SUPPORT

AKP Group Chairman Abdullah Güler hosted the group deputy chairmen of the parties in the "Advisory Board" room at the Turkish Parliament and exchanged information about the execution regulation and other legislative proposals. During the meeting, support was requested to pass the execution regulation before the holiday. However, no draft text was presented to the group deputy chairmen.

PRINCIPLE OF EQUALITY AND EXCEPTIONS

The "equality in execution" principle will be taken as the basis in the execution package, and terror offenders will also be able to benefit from the reductions that judicial offenders benefit from. However, it is stated that sexual crimes may be excluded from this regulation. Additionally, it is planned to soften the powers of penal execution boards and administrative observation boards in favor of the detainees.

Detailed regulations are envisaged for the rehabilitation of prisoners through methods such as working in public service, providing education, and teaching professions. These regulations are aimed at contributing to the reintegration of prisoners into society.
