MHP's Feti Yıldız had signaled it: Release application for Demirtaş
A release application has been filed for Selahattin Demirtaş. Lawyers for Demirtaş, who remains imprisoned despite ECHR rulings, have applied to the appellate court requesting his release.
Former HDP Co-Chair Selahattin Demirtaş has not been released from prison, where he has been held since November 2016, despite rulings of rights violations by the European Court of Human Rights (ECHR) and the Constitutional Court (AYM). Citing the ECHR's previous rulings on violations and release, Demirtaş's lawyers filed an appeal with the Ankara Regional Court of Justice on September 24, 2025, requesting his release.
The application also refers to the second violation and release ruling issued by the ECHR regarding Demirtaş, and the relevant chamber is expected to make a decision regarding the release request next week.
DETAILS OF THE APPEAL
The Ankara 22nd High Criminal Court announced the reasoned decision for the Kobani case, spanning approximately 30 thousand pages, 13 months later. Demirtaş's lawyers prepared a comprehensive 400-page appeal document for him. This application was submitted to the Ankara Regional Court of Justice on September 24 and was officially registered.
STATEMENT FROM MHP'S FETİ YILDIZ
In a statement regarding Demirtaş's release request, MHP's Feti Yıldız noted that ECHR rulings are binding on the Constitution, stating, "With Article 90 of the Constitution standing there, of course, some things need to be done."
APPEAL PERIOD ENDS ON OCTOBER 8
The deadline for Turkey to appeal the ECHR's second violation and release ruling regarding Demirtaş expires on October 8. If Turkey does not appeal, the ECHR ruling is expected to become final. For this reason, all eyes are on the date of October 8.
Demirtaş's lawyer, Mahsuni Karaman, recalled the ECHR's rights violation ruling and emphasized that October 8, 2025, is a critical turning point for the release process.
