New chapter in CHP's party congress lawsuit: Rapporteur judge begins review

The judicial process concerning the CHP's 38th Ordinary Congress, held on November 4-5, 2023, has moved to the Court of Cassation stage. It has been reported that following the appeal against the decision of the 36th Civil Chamber of the Ankara Regional Court of Justice, the file has been taken into the "preliminary review" stage at the 3rd Civil Chamber of the Court of Cassation.

The decision in question included not only the ruling that the congress was flawed by "absolute nullity" and should be annulled, but also an assessment regarding the reinstatement of Kemal Kılıçdaroğlu, who was in office before the congress, along with the members of the Party Assembly and the High Disciplinary Board, to their duties as a precautionary measure "until the decision becomes final."

The file was sent to the 3rd Civil Chamber of the Court of Cassation for appellate review on Friday, July 17, before the start of the judicial recess. Since registration and distribution procedures for files can still be carried out during the judicial recess, the initial administrative stages of the process have been completed.

With the status of the file at the Court of Cassation updated from "registration stage" to "preliminary review," it is stated that the rapporteur judge will begin working on the file. Once the rapporteur judge completes their review, they will submit their report to the chamber panel that will issue the final decision.

The substantive assessment of the file is expected to take place after September 1, when the new judicial year begins. For this reason, all eyes are on the steps the 3rd Civil Chamber of the Court of Cassation will take in September regarding the judicial process of the CHP congress.
