Statement on the framework law from Kılıçdaroğlu

Statement on the framework law from Kılıçdaroğlu

Following the approval by the TBMM Justice Commission of the framework bill aimed at establishing the legal basis for the resolution process dubbed "Terror-Free Turkey"  a statement came from Kemal Kılıçdaroğlu. In an assessment shared on his social media account, Kılıçdaroğlu announced that his party would provide "unwavering support" to the process.

In his statement, Kılıçdaroğlu emphasized Turkey's unity and integrity. Stating that differences are not a cause for division but rather a richness of the common homeland, Kılıçdaroğlu expressed that the process should be handled with the goal of strengthening the country's internal peace and brotherhood.

CHP'S EMPHASIS: UNITARY STRUCTURE AND BROTHERHOOD

While explaining his party's approach, the CHP leader stated that the unitary state structure, the first four articles of the Constitution, and the indivisible brotherhood of society are non-negotiable for them.

Kılıçdaroğlu expressed that their understanding of nationalism and patriotism is to "unite the nation" and "walk shoulder to shoulder under the same flag." He emphasized that Turkey must act with the goal of a strong democracy, a robust economy, and a reputable foreign policy.

In his statement, Kılıçdaroğlu, who gave a message of support for the process, also stated that they would take a stand against structures that want to create a ground for new internal turmoil, division, and conflict in Turkey. He expressed that the CHP Group would act not only as a supporter but with an understanding that "takes responsibility, leads, and shows the right direction."

LEGISLATIVE CALENDAR AND SCOPE OF THE BILL

The Bill on Strengthening National Solidarity and Social Integration was submitted to the TBMM Presidency on Wednesday, August 5, with the signatures of 360 deputies. The bill was approved by the TBMM Justice Commission on August 8. All eyes are now turned to the General Assembly deliberations, which are expected to begin on Monday, August 10.

The 12-article bill includes provisions regarding crimes committed within the scope of establishing or managing the PKK/KCK, membership in the organization, aiding, propaganda, and organizational activities. As a prerequisite for benefiting from the regulation, it is stipulated that the National Security Council's (MGK) decision regarding the dissolution of the terrorist organization must be published in the Official Gazette. If this condition is met, a 6-month period will be granted for applications.

The bill aims to establish the legal framework for the "Terror-Free Turkey" process.

The bill includes regulations regarding the suspension of trials or sentences based on the nature of the crime and the prescribed sentence duration. Accordingly, a 5-year suspension is foreseen for crimes requiring a prison sentence of 15 years or less, and a 10-year suspension for crimes requiring more than 15 years. It is stipulated that the suspension decision will be revoked if a "terror crime" is committed during this period.

A political ban of 2 to 3 years for those who will benefit from the regulation is also among the articles of the bill. Intentional killing committed within the scope of organizational activity and crimes committed before June 1, 2005, that require life imprisonment or aggravated life imprisonment are excluded from the scope. For this reason, it is stated that PKK leader Abdullah Öcalan will not be able to benefit from the regulation.

The bill envisions the establishment of a board chaired by Vice President Cevdet Yılmaz for the monitoring, supervision, and coordination of the process, and a 17-member monitoring commission in the Parliament. The regulation also includes a provision stating that no criminal liability will arise for public officials who will serve within the scope of the law.
