In this case, deaths determined not to have been caused by the earthquake can also benefit from the sentence reduction advantage. For example, if a building collapsed due to the earthquake but no deaths occurred, those responsible for the building can benefit from this regulation.

Furthermore, it was emphasized that it must be confirmed that the death was definitively the result of the earthquake. In cases where earthquake-related deaths are not recorded or are incorrectly identified, those responsible can still receive a sentence reduction.

Another point highlighted in the article is that those responsible for past mining disasters could also receive sentence reductions under this regulation. Those responsible for major mining accidents such as Soma and Ermenek can also benefit from this reduction under certain conditions.

As Tahincioğlu noted, there is a complex point in the regulation regarding collapses and deaths. For example, if deaths occurred in a hospital building due to panic following the earthquake, these deaths can also be evaluated within the scope of the sentence reduction. Furthermore, even if the building was constructed in accordance with regulations, if a collapse occurred due to the magnitude of the earthquake, those responsible can still benefit from the sentence reduction advantage.

Tahincioğlu's article also touched upon other controversial issues within the scope of the regulation. Those responsible for many crimes, from serious workplace accidents to traffic accidents, can also receive sentence reductions with this regulation. Even serious crimes such as murder can benefit from this reduction under certain conditions. The same regulation is applied without making a distinction between murder charges and cases involving self-defense or deaths resulting from accidents.
