Between October 7 and October 13, 2024, notable developments occurred among the regulations published in the Official Gazette. Attorney Ozan Can Karahan evaluated the developments that took place last week.

Here is Attorney Ozan Can Karahan's evaluation of the Official Gazette:

Upon the application of the Council of State, the Constitutional Court annulled the regulation stating that public officials who were dismissed under the State of Emergency (OHAL) and subsequently reinstated could not claim compensation. (2024/89 E.-2024/148 K.)

The Ministry of Agriculture and Forestry published a new communiqué regarding businesses holding alcohol licenses. According to the communiqué, the emblem or logo of an alcoholic beverage may be featured on glasses, goblets, trays, ice buckets, and bottle openers where the drink is served. However, these items bearing the emblem cannot be used for any service other than alcoholic beverages, and there shall be no descriptions or any indications related to the drink on these items other than the logo. The communiqué will enter into force in 6 months. (2024/18)

The Grand National Assembly of Turkey (TBMM) decided to establish a parliamentary research commission to "determine the measures that need to be taken for the protection of children from all forms of violence, neglect, and abuse, and for the development of their mental, spiritual, and physical health." The commission will consist of 22 members and will complete its work within 3 months. (Decision no: 1427)

The Council of Forensic Medicine was restructured by a Presidential Decree. In the institution, which will complete its administrative restructuring by December 31, 2024, the number of specialized boards, which was 8, has been increased to 11. While the duties of some specialized boards were redefined, new areas of expertise were added to others, and the number of experts constituting each board was increased. With the new regulation, administrative units such as the Department of Personnel, Department of Support Services, Department of Information Technology and Statistics, Department of Education, Research and Development, Department of Quality and Accreditation, and Legal Consultancy were also established within the institution. The Energy Market Regulatory Authority (EPDK) amended the Electricity Market Licensing Regulation, making all types of direct share changes, as well as indirect partnership structure changes of 10% or more, subject to Board approval, with some exceptions.

The TBMM decided to establish a parliamentary research commission to "prevent women from being subjected to all forms of violence and discrimination, to review existing regulations in this field, and to determine the additional measures that need to be taken." The commission will consist of 22 members and will complete its work within 3 months. (Decision no: 1429)

The Ministry of Youth and Sports published the "Regulation on the Audit of Sports Clubs, Sports Joint-Stock Companies, and Parent Organizations." Accordingly, clubs will be audited financially and administratively by the Ministry every 3 years. The financial statements, declarations, annual activity reports of the clubs, their compliance with budget and expenditure principles, and all types of transactions carried out by all their bodies may be subject to audit with experts if necessary. Furthermore, the Ministry may also have the clubs audited by independent auditors authorized by the Public Oversight, Accounting and Auditing Standards Authority regarding their financial status and profit-loss accounts. Since publicly traded sports joint-stock companies are subject to capital market legislation, this regulation will also apply to publicly traded sports joint-stock companies, provided that it does not conflict with the Capital Markets Board (SPK) regulations.
