Ministry of National Defense imposes tender ban on 1 person and 1 company

The Ministry has banned Serra Dar Dokuma Turizm Sanayi ve Ticaret Limited Şirketi, registered with the Istanbul Chamber of Commerce, and Hacer Anıkaydın, registered with the Afyonkarahisar Chamber of Electricians and Electronic Technicians, from participating in tenders for a period of 1 year.

As reported by GazeteDuvar, the decision was taken within the scope of Public Procurement Contracts Law No. 4735.

In the event that one of the acts listed in Article 25 of the Law, titled "Prohibited acts and behaviors," occurs, real and legal persons may be banned from participating in tenders. The prohibitions in the law are as follows:

- To rig or attempt to rig transactions related to the contract through fraud, promises, threats, use of influence, providing benefits, collusion, extortion, bribery, or other means.

- To forge or use forged documents, or to attempt to do so.

- To use fraudulent materials, tools, or methods during the execution or delivery of the work subject to the contract, or to perform manufacturing that is contrary to technical and artistic rules, incomplete, faulty, or defective.

- To cause damage to the administration while fulfilling the commitment.

- To use knowledge and experience to the detriment of the administration or to act in violation of the provisions of Article 29 (Prohibition on disclosing information and documents).

- Except for force majeure, to fail to fulfill the commitment in accordance with the tender documents and contract provisions.

- To transfer or take over the contract in violation of the provisions of the law.
