Official Gazette published: Change in collective bargaining agreement

According to the decision published in today's issue of the Official Gazette, an amendment has been made to Article 4 of the Regulation on Business Lines within the scope of collective bargaining agreements.

Article 4 of the Regulation on Business Lines has been amended as follows:

ARTICLE 4- The determination of the business line is carried out upon the application of the employer, or the employer's or workers' union.

The business line in which a workplace is classified is determined by the Ministry of Labor and Social Security upon application, based on the nature of the work performed at the workplace. A lawsuit may be filed against the determination within 15 days after the publication of the decision, in accordance with the Law on Trade Unions and Collective Bargaining Agreements.

An employer requesting a change in business line must have submitted their request to the relevant institution before the authorization process for a new collective bargaining agreement begins. Otherwise, the determination of the business line change shall only be considered valid for the next term. Requests for business line determination and lawsuits filed in connection with them do not cause the suspension of authorization determination procedures and lawsuits.

Until a new business line determination study is conducted, workplaces are classified according to the business line to which the union that received the last authorization certificate is affiliated. This situation is a temporary measure to protect the rights of workplaces and employees.
