Court temporarily halts 'Apple ban'

Following the US International Trade Commission's decision to ban the import and sale of Apple's smartwatch models, the Apple Watch Ultra 2 and Apple Watch Series 9, based on a complaint by Masimo, the Appeals Court evaluated Apple's request to stay the decision.

The court has temporarily halted the decision to ban the sale of Apple's newest smartwatch models in the US.

THE DECISION WAS NOT VETOED

The decision by the US International Trade Commission in October to instruct Apple to stop the import and sale of the smartwatches in question, following Masimo's complaint, was not vetoed by the administration of US President Joe Biden.

With the Biden administration, which had until December 25 to issue a veto, choosing not to do so, the sale of the Apple Watch Ultra 2 and Watch Series 9 had been banned in the US.

Apple had appealed the decision by applying to the Federal Appeals Court. Requesting a stay of the decision, Apple had asked for the wait for the assessment of US Customs and Border Protection, which is set to decide by January 12 whether redesigned versions of the watches infringe on Masimo's patents.
