EU accuses Meta of 'addictive design' on Facebook and Instagram

The European Commission (EU) has reached preliminary findings that certain design features used by Meta on Facebook and Instagram increase the risk of addiction by keeping users on the platforms for longer periods.

According to the Commission's statement, the investigation focused on whether elements such as infinite scrolling, auto-play, push notifications, and highly personalized recommendation systems are compliant with obligations under the Digital Services Act (DSA).

The EU stated that the risks these features may pose to the physical and mental health of users have not been sufficiently assessed. The statement noted that infinite scrolling and auto-play, in particular, may encourage unhealthy usage habits and compulsive usage behaviors.

The Commission also holds the view that Meta does not take into account existing information regarding the time children spend on Instagram or Facebook during nighttime hours. The statement indicated that the company's risk mitigation measures have not demonstrated an effective response to the risks stemming from addictive design.

The preliminary findings do not constitute a final decision in the investigation. Meta has the right to present its defense. If the Commission issues a finding of infringement, the company could face administrative fines of up to 6 percent of its global annual turnover.
