PayPal and Apple Pay are coming to Turkey! New law removes obstacles!

The Law on the Protection of Personal Data, which includes amendments to align with the European Union's General Data Protection Regulation (GDPR), was published in the Official Gazette today.

Especially following the Cambridge Analytica scandal, the importance of personal data and its security has been handled with even greater sensitivity by governments.

The proposal titled "Law Proposal on Amendments to the Criminal Procedure Code and Certain Laws and the Decree-Law No. 659" aims to make the KVKK (Personal Data Protection Law) compatible with the European Union's General Data Protection Regulation (GDPR).

Articles and exceptions after the amendment:

The processing of special categories of personal data is prohibited. However, the processing of this data is possible if:

The data subject has given explicit consent.

It is clearly stipulated by law,

It is necessary for the protection of the life or physical integrity of the person or another person who is unable to express their consent due to actual impossibility or whose consent is not legally valid,

It relates to personal data made public by the data subject and is in accordance with the intent to make it public,

It is necessary for the establishment, exercise, or protection of a right,

It is necessary for the protection of public health, preventive medicine, medical diagnosis, treatment and care services, and the planning, management, and financing of health services by persons or authorized institutions and organizations under the obligation of confidentiality,

It is necessary for the fulfillment of legal obligations in the fields of employment, occupational health and safety, social security, social services, and social assistance,

It is carried out by foundations, associations, and other non-profit organizations or entities established for political, philosophical, religious, or trade union purposes, provided that it is in accordance with the legislation and their objectives, limited to their fields of activity, and not disclosed to third parties; and is directed towards their current or former members or persons who are in regular contact with these organizations and entities,

is possible.
