Formal notice to the TFF from a Süper Lig club!

İstanbulspor Club President Ecmel Faik Sarıalioğlu has sent a formal notice to the TFF, which has failed to call for elections despite 147 delegates signing a petition demanding an immediate elective general assembly. Representing the clubs that collected the signatures, Sarıalioğlu sent an informative message following the delivery of the notary-certified formal notice. Here is that message and the formal notice;

Dear Presidents, as İstanbulspor, I have sent our formal notice today, which is the first stage of the legal process. You can see the notary-certified version in the attachment. This version has been prepared according to the latest situation as of today. I am sending you a copy of this text in the attachment. Our Presidents who have signed can send the same. However, if there are any new signatures, they can contact us before sending it so we can share whether the list is up to date. Hoping it leads to good outcomes...

Subject: Formal notice regarding the demand to comply with the "Extraordinary Elective General Assembly" call made by TFF General Assembly Delegates in accordance with Article 29 of the TFF Statutes, and a warning that legal action will be taken if not complied with.

Explanations:

Dear Addressee,

Due to the current situation of Turkish football, an "Extraordinary Elective General Assembly" call has been made via notary by the attached 147 people, who are TFF General Assembly Delegates, in accordance with Article 29/2 of the TFF Statutes. (Attached Notary Detailed Delegate Call List)

Since the aforementioned call is requested by more than 130 delegates, which corresponds to 40% of the 325 people who are delegates in accordance with Article 22 of the TFF Statutes (announced as 324 by the TFF); it is mandatory for the TFF Board of Directors to convene an "Extraordinary General Assembly" within 30 days at the latest, in accordance with Article 29/2 of the TFF Statutes.

In the statements made on the TFF website, there are expressions regarding the "authority" of the delegates in the formal notices sent to the TFF and their "withdrawal of signatures." However, in accordance with the provisions of Article 22/2 of the TFF Statutes and Article 9 of the TFF General Assembly Internal Regulations, the TFF Board of Directors has no right to make any decision regarding delegate authority or the withdrawal of signatures; furthermore, according to the statements on the TFF website, the TFF Board of Directors is usurping the authority and duties of the General Assembly, which is the highest decision-making body of the TFF.

Moreover, no legal norm provides legal protection for the right of an organ, against which demands for decisions have been made, to make decisions regarding those demands. If the opposite were accepted, the TFF Board of Directors would not take any of the demands of the delegates who made requests against it into consideration, in line with its own discretion. Since this would be a direct obstruction of the exercise of the democratic and legal rights of the TFF General Assembly Delegates, it is mandatory for the TFF Board of Directors to abandon this usurpation of authority and duty. In this direction; the TFF Board of Directors, which is separately bound by Law No. 5894, the TFF Statutes, and the TFF General Assembly Internal Regulations, must convene an "Extraordinary General Assembly" within 30 days at the latest from the date of the formal notice by making a call in accordance with Article 29 of the TFF Statutes, following the "Extraordinary Elective General Assembly" request of the 147 attached delegates. In the event of acting to the contrary, no decision taken by the TFF Board of Directors, whose legal existence becomes questionable due to the failure to convene the TFF General Assembly within 30 days at the latest after the date of the formal notice with the "Extraordinary General Assembly" call, including the "registration of the leagues," will have any legal protection or legal validity.

Therefore, in the event that the TFF Board of Directors acts to the contrary, in addition to the application to be made to FIFA; we hereby notify you by way of formal notice and warning that requests will be made before the courts regarding the usurpation of duty and authority by the TFF Management, and that applications for abuse of office will be filed against the TFF Board of Directors members and professionals who show the will to act contrary to the TFF Law, TFF Statutes, and TFF General Assembly Internal Regulations.
